“Revolution never stops”: Baburam Bhattarai

WPRM: Thank you for meeting with us today. In your article in The Worker #4 ‘The Political Economy of the People’s War’ you write that “the transformation of one social system into another, or the destruction of the old by the new, always involves force and a revolutionary leap. The People’s War is such a means of eliminating the old by a new force and of taking a leap towards a new and higher social system.” Why then did the Maoist party enter the peace process and attempt to change society through Constituent Assembly elections?

Baburam Bhattarai: This is a very important question related to the basic tenets of Marxism-Leninism-Maoism (MLM). The basic motive force of history is the contradiction between the existing level of productive forces and the production relations within society. At a certain stage this contradiction sharpens and there is a break with the old relationship and a leap to the new one. We call this social revolution. That leap necessarily confronts a certain force, because every set of productive relations is backed by a state, and the state means basically the organised force of the army. To break with the old mode of production and leap into a new one, you have to break all the relations within the state backed by the army. And that inevitably requires the use of force. This is a law of history and a basic principle of MLM which nobody can revise. If you revise or abandon it then you are no longer a Marxist. There is no question of our party ever ending this basic principle.

By adhering to this basic principle we waged armed Protracted People’s War (PPW) from 1996 to 2006. But after 2006 we made a certain departure in our tactical line. Some people are confused about this and think we have abandoned PPW forever and adopted a peaceful path of social development. This confusion needs to be cleared. What we are saying is that People’s War is a multifaceted war where both the armed and political form of struggle needs to be combined.

Protracted People’s War (PPW) is a military strategy to be adopted in a semi-feudal, semi-colonial context, and, in the different context of imperialism, could be applied in a modified form even in imperialist countries. But basically the theory of PPW as developed by Mao was to be applied in semi-feudal, semi-colonial countries. That’s why the military line adopted in the case of Nepal was basically a line of Protracted People’s War, which we developed through the course of our struggle, applying it very creatively in Nepal for ten years. And we were successful in developing this war from the stage of strategic defensive to the stage of strategic equilibrium and on to the stage of strategic offensive. We basically established the strategic offensive, which means the final stage of capturing state power and which must be meticulously calculated and applied. If you don’t take note of the existing balance of forces, both politically and militarily in the country and outside, firstly it will be difficult to capture state power and secondly even after capturing state power it will be difficult to sustain it. That’s why we introduced certain new features.

People know only the negative part, but what they forget, or what we have been unable to propagate well since the beginning of the PPW, is the new context of world imperialism and the specific geopolitical context of Nepal. In this context, our party decided that we need to adopt some of the features of general insurrection within the strategy of PPW. Therefore the basic strategy will be PPW, but some of the features of general insurrection, which relies on people’s movement in the urban areas and leads to the final insurrection in the city, the tactics of the general insurrection, should also be incorporated within that strategy. This has been the basic question within our party, the Unified Communist Party of Nepal (Maoist) [UCPN(M)]. This idea we first introduced in our national unity congress in 1991 and after that when we had our 2nd national conference in 2001. At that time we developed the theory of fusion of PPW and general insurrection to a new level, so that in the specific context of Nepal, while adhering to the basic path of PPW, the tactic of general insurrection should be fused within that strategy. That’s why at that conference we put emphasis on this aspect. But we thought that when we developed this new political line, developed through the course of the People’s War in Nepal, that it needed to be assessed more thoroughly in the international community of Maoists.

We called this one of the features of Prachanda Path, which we regarded as a new development in the theory of MLM. After 2001 we still adhered to the People’s War but we resorted to some of the tactics of general insurrection, that’s why when we were in the People’s War we always talked of political negotiations and we actually had two rounds of political negotiations. During that time we raised the issues of Constituent Assembly, abolition of the monarchy and establishment of a bourgeois democratic republic. These were the tactics we followed while we were in the PPW. Why we did that was because in the specific conditions of Nepal, though we are in the stage of transition from feudalism to capitalism, in our case the feudal system had been basically led by an autocratic monarchy for thousands of years. In most third world countries autocratic monarchy has already been abolished, and in those countries though the basic foundation of society is still semi-feudal, semi-colonial, the political superstructure was led by bourgeois democrats. But in our case even the political superstructure was dominated by the autocratic feudal monarchy, the national bourgeoisie was very weak and they could not carry forward the bourgeois democratic revolution. It was the proletarian party which had to take the lead to abolish the autocratic monarchy and introduce a bourgeois democracy, which could be again transformed through struggle into New Democracy, a proletarian democratic system.

Therefore we adopted these tactics, and after 2001 we followed these tactics and by 2005 we had reached the stage of strategic offensive in the PPW. Then we thought it was time to focus our activity, to shift our activities to the urban areas. By that time we had liberated most of the countryside, where the poor peasantry lives, and under 25% of our population lives in urban areas. There the petty bourgeoisie class and other classes needed to be mobilised if we were to complete the stage of strategic offensive and capture the state in a revolutionary manner. After 2005 we decided to shift our activity to the urban areas, because without mobilising the masses in urban areas we couldn’t complete our strategic offensive, capturing the state. With these tactics in mind we entered into the negotiation process with certain parliamentary parties who were all struggling with the monarchy but which were too weak, their class nature was too weak, they couldn’t struggle with the monarchy and complete the bourgeois democratic revolution. When the autocratic monarchy centralised all state power in a coup, it was easier for us to have an alliance with those bourgeois democratic parties and we made the 12-point understanding. On the basis of that 12-point understanding we launched a mass movement which we called the 2nd mass movement. After the 2nd mass movement there was a huge upsurge of the people and the autocratic monarchy was forced to accept the Constituent Assembly and to step down. After that we made the Comprehensive Peace Agreement, in which we had to make certain compromises. Those compromises were made to abolish the monarchy, hold the Constituent Assembly elections and then move ahead to complete the bourgeois democratic revolution in the country.

There are some ambiguous features in the Comprehensive Peace Agreement. Our understanding, the revolutionary party’s understanding, was that after abolishing the monarchy and establishing a bourgeois democratic republic, the proletarian party would take the initiative and launch forward the struggle towards New Democratic Revolution. We knew the bourgeois forces, after the abolition of the monarchy, would try to resist, and our main contradiction then would be with the bourgeois democratic parties. This we had foreseen. So we have not said that after the abolition of the monarchy we’ll stop there. We never said that. What we have said is that we would align with the bourgeois democratic parties to abolish the monarchy, and after the abolition of the monarchy then the contention would be between the bourgeois forces and the proletarian forces. A new field of struggle would start. That was clearly stated in the Comprehensive Peace Agreement, the subsequent interim constitution and other documents we passed.

After the Constituent Assembly elections, when our party emerged as the largest force and we abolished the monarchy, there was a lot of enthusiasm among the masses of the people. Our party’s tactical line had been correctly implemented. That gave a tremendous force to the basic masses of the people and our support greatly increased. For the time being we cooperated with the interim government also, because by participating in that coalition government we thought we could work within the bureaucracy, within the army, within the police and within the judiciary, in order to build our support base through those state structures, which would help us for future revolutionary activities. With that in mind we participated in the coalition government. After the abolition of the monarchy, when the main contradiction would start with the bourgeois democratic forces, then our struggle took a new turn.

After April 2009 [when Prachanda resigned from government], that phase of the Constituent Assembly and implementation of the bourgeois democratic republic was more or less complete. Our understanding is to now carry on the struggle forwards to complete the New Democratic Revolution. So again we made a tactical shift, showing that from now on our major fight would be with the bourgeois democrat parties who are backed by imperialism and the expansionist forces. With this thinking our party left the government and now we are focusing on the mass movement, so that now we could really practice what we have been preaching. That means the fusion of the strategy of PPW and the tactic of general insurrection. What we have been doing since 2005 is the path of preparation for general insurrection through our work in the urban areas and our participation in the coalition government.

But what one should not forget was that we had never ever surrendered the gains of the PPW, what we had gained during the ten years of struggle. We had formulated the People’s Liberation Army (PLA), we had our base areas, we had a lot of mass support, and all this we have been able to preserve. But we have not been able to convey to our comrades outside the country that the gains of the People’s War were never surrendered. The PLA is still with us, and the arms we collected during that war are still with us within the single-key system, monitored by the United Nations team, but basically the key is with us and the army is with us and we have never surrendered. This shows we have not abandoned the path of PPW. What we have done is suspended that part of the activity for some time and focused more on the urban activities so that we could make a correct balance between the military and political aspects of struggle. After some time we will be able to combine both aspects of PPW and general insurrection to mount a final insurrection to capture state power. We would like to stress that we are still continuing in the path of revolution, but the main features we tried to introduce were to make a fusion between the theory of PPW and the tactic of general insurrection. After coming to the peaceful phase I think whatever confusion there was has been mitigated and people realise we are still on the revolutionary path.

Now we are preparing for the final stage of the completion of the New Democratic Revolution. In a few months when the contradiction will sharpen between the proletarian and bourgeois forces, maybe there will be some intervention from the imperialist and expansionist forces. During that time we may again be forced to have another round of armed clashes. Our party is already aware of that and we have decided to again focus on the basic masses of the people both in urban and rural areas. To strengthen those mass bases we have formed the United National People’s Movement, which will be preparing for both struggle in the urban areas and to strengthen our mass base in the countryside. In the decisive stage of confrontation with the reactionary forces we could again combine our bases in the rural areas and our support in the urban areas for a final assault against the enemy to complete the revolution.

I would like to say we have never abandoned PPW, the only thing is that there has been a tactical shift within the strategy. This is one point. The other point is that being a Maoist we believe in continuous revolution. Revolution never stops. Even when one stage is completed, immediately the new stage should be continued. Only that way can we reach socialism and communism. That is a basic tenet of Maoism. Being a Maoist, this reasoning of continuous revolution can never be abandoned. We are still in the course of PPW, though the tactics have shifted according to the nature of the time. But there is a confusion in the international community of proletarian forces, and we would like to clarify this, but I think this thing can be better done in practice than in words. Anyhow we are confident we can convince our comrades who have some doubts about our activities that we are still pursuing the path of revolution. We will complete the revolution in a new way and we have to show that revolution is possible even in the 21st century. And Nepal can be a model of revolution in the 21st century.

WPRM: Can you explain how the UCPN(M) understands the nature of the state in this transitional period? Can the New Democratic Revolution be completed through the holding of an election?

Baburam Bhattarai: The key question in any revolution is the question of the state. The state is simply an instrument of dictatorship of a certain class. Right now in Nepal the existing state is a dictatorship of the feudal, comprador and bureaucratic capitalist classes. So the task of the revolution is to smash this state and replace it with a New Democratic one. This is the basic objective of the revolution. But in the special case of Nepal, the semi-feudal, semi-colonial state was presided over by an autocratic monarchy and it was being backed by foreign imperialist and expansionist forces. Our party, the UCPN(M), therefore thought it more prudent first to do away with the autocratic monarchy and establish a bourgeois democratic republic and then immediately go towards New Democratic Revolution. Those were the tactics adopted by us. We took the initiative to abolish the monarchy under the leadership of the proletariat which was a tremendous boost for the proletarian forces within our country. It also marginalised the bourgeois democratic forces because they had not taken the lead in that phase of the revolution. After the implementation of these tactics and the abolition of the monarchy, we have established a bourgeois democratic republic in this country, which basically still is a dictatorship of the feudal landlord, comprador and bureaucratic capitalist classes. But politically, since the proletarian forces took the initiative to establish this transitional state, there is contention between the reactionary classes and the progressive classes. A sort of flux has been created, it has not been stabilised. Within this nature of the state, which is in flux, we think it will be easier for the revolutionary forces to intervene and further destabilise the state, putting pressure on it from outside the state which can be smashed to make a New Democratic state.

The nature of the transitional state is, to put it very concisely, in principle a dictatorship of the reactionary forces. But in practice, since the proletarian forces played a leading and decisive role in dismantling the autocratic monarchy and creating this transitional state, the political authority of the progressive, patriotic and proletarian forces is high. So this interim state won’t be very stable and if we can correctly mobilise the masses of people it can easily be overthrown and replaced by a New Democratic state. We think this is a new experiment being carried out in Nepal, it has not happened like in China where they directly implemented the revolutionary policies of the party and overthrew the old state replacing it with a new one. But in our case it has meant cutting up the state part by part, in fact we are devouring it part by part. Ultimately we will be able to smash it and then replace it with a new state. This does not mean we are trying to reform the whole state, indeed the whole state has to be totally displaced by a new state. There is no confusion on our part on this question. But the method of destroying the whole state is partly new in our case because it was presided over by an autocratic monarchy not by bourgeois democratic parties as seen in other third world countries. Because of this specificity of Nepal, this transitional state has been a new thing not seen elsewhere. But our party is very clear on the question that the state needs to be totally destroyed and replaced by the new state. We are working on that line and our party feels that after the formulation of the strategy of People’s War and general insurrection we will be able to finally mobilise the masses of the people in a mass upsurge and insurrection to abolish this state and replace it with a New Democratic one.

WPRM: After the resignation of Chairman Prachanda from the government and the coup by President Yadav over the affair of General Katuwal, the main revisionist party, the CPN-UML, is now leading the government and you are heading the recently formed United National People’s Movement (UNPM). Can you tell us the plan of the party in leading People’s Movement-3 and carrying out insurrection in this situation?

Baburam Bhattarai: As I told you, the basic orientation of our party is to complete the New Democratic Revolution in a new way in Nepal. By firmly sticking to that line we are practicing different tactical shifts. Accordingly, after we completed this task of elections of the Constituent Assembly and the establishment of democratic republic, now our next task is to organise a people’s movement and develop it into an insurrectionary upsurge and complete the New Democratic Revolution. Now we have entered that phase. During this phase we will focus more on organising and mobilising the masses and leading them towards a revolutionary upsurge. That means certain changes in the policy as had been practiced during the People’s War. During that time our focus was on the peasant masses, which was slightly different than the struggle in the urban areas which consists of basically the working class.

To lead this phase of the movement we have set up the new UNPM, which is basically a revolutionary united front of the patriotic, democratic and left forces led by the Communist Party. We have put forward a list of 25 demands related to nationalism, democracy and people’s livelihood. With these demands we have mobilised the masses of people. At a certain stage the contradiction with the bourgeois democratic forces and the imperialist expansionist forces will reach a higher stage. At that time there will be a decisive clash between the reactionary and revolutionary forces. That will be the insurrectionary upsurge. This is the view of the people. So with this in mind we have been organising plans and struggles, mass struggles which we will be carrying out in subsequent months. As Marx and Lenin correctly pointed out, you must believe firmly in the tactics of insurrection. If you have to organise insurrection you have to make a decisive action and take it to the final conclusion. If you can’t do that you will be defeated. To prepare for that decisive struggle you have to move through different stages, that’s why after leaving the government we are now focusing more on the issue of civilian supremacy so we can isolate the militarist section of the reactionaries. Secondly we are focusing on the question of nationalism so we can organise the broad masses of patriotic forces against imperialist and expansionist intervention. Thirdly we are raising the issue of land reform and the basic question of livelihood among the general masses of the people, so that the poor masses of the people and the petty bourgeoisie classes can be organised.

With this in mind we are carrying on a plan in the coming few months, there will be a broad unity of patriotic, democratic and revolutionary forces, which can mount a final struggle against the reactionary forces, the bourgeois democratic forces backed by the foreign imperialist forces. We think this will lead to a proper movement and a final insurrectionary upsurge of the masses of the people. If we are able to play the contradiction between the reactionary forces within the country and the imperialist and expansionist forces outside, then at an opportune moment we can organise an insurrectionary upsurge and be victorious. Therefore we have established the UNPM and put forward protest programs. In the next few months when the contradiction will sharpen among the reactionary forces while making the new constitution, during that time this new movement will arise when the people will finally come to revolt and complete the New Democratic Revolution. This is all I want to say on this for now.

WPRM: In the past you have written of the need to confiscate the land of feudals and the capital of comprador and bureaucrat capitalists, and the party has carried this out to some extent. Is this still the plan of the UCPN(M)?

Baburam Bhattarai: To complete the New Democratic Revolution you have to smash the feudal production relations and culture, that means we have to confiscate the property of the feudal landlords and distribute it to the peasants on the principle of ‘land to the tiller’. This was the basic policy of our party during the People’s War, which we practiced in the rural areas. Nepal is geographically divided between the hilly regions and the plains areas and most of the land is in the plains. But in the plains it was difficult to carry out guerilla warfare, so we just entered there and implemented some land reform policies. Since the plains border India and there is a danger of foreign intervention there, we have never been able to completely practice land reform in those areas. This will only be implemented after the final victory of the revolution. During the People’s War this policy, the principle of ‘land to the tiller’, was practiced more clearly in the hilly areas and partly in the plains areas bordering India. But we subscribe to the policy of abolishing feudal landowners because without making the real tillers of the land, the peasants, the owners of the land, we can’t bring about the land revolution and can’t complete the New Democratic Revolution. So our basic policy remains abolishing the feudal property relations and introducing a socialist-oriented national bourgeois democratic revolution. That is our policy on the question of land.

On the question of capital, for countries like ours, a semi-feudal and semi-colonial country, capital is basically dominated by imperialist capital. In our case Indian expansionist capital in particular. The nature of capital in Nepal at the moment is comprador and bureaucratic. This means it is dependent, you cannot have national independence in the country. That’s why we want to do away with this bureaucratic and comprador capital and convert it into national industrial capital which can subsequently be organised in a socialistic manner. With this policy in mind, we intend after the completion of the revolution to confiscate all this bureaucratic and comprador capital and convert it into national capital which can be reorganised into a socialist mode of production. This is our policy to do away with all the remnants of feudal landlordism, abolition of bureaucratic and comprador capital, and reorganisation of the economy, firstly under a New Democratic line and then in transition towards socialism.

WPRM: The UCPN(M) has brought forward ideas around elections in a New Democratic and socialist state. In your article on ‘The Question of Building a New Type of State’ in The Worker #9, you particularly discuss the need for greater democracy among the people. How will the holding of elections solve the problems generated by the weaknesses of the experience of socialism in the 20th century?

Baburam Bhattarai: This question of democracy and dictatorship is also very important for the communist movement. In principle every state is a dictatorship of a certain class, so-called democracy is also a form of bourgeois dictatorship. This is a basic tenet of MLM and nobody can deny that. But what was practiced in the 20th century in different people’s democracies and socialist countries was, though in theory correct, in practice the real democratic institutions and processes were minimised. Democracy is a class concept, and bourgeois democracy has its own rules, but proletarian democracy also needs to be developed. What happened in the Soviet Union was that the Soviet, a democratic institution, and the working class became very functional, especially during Comrade Stalin’s time. In reality the Soviets couldn’t be very functional and they gradually turned into a bureaucratic state apparatus. After the counter-revolution in the Soviet Union, Comrade Mao Zedong drew certain lessons and he wanted to expand the scope of proletarian democracy. That’s what he practiced during the Great Proletarian Cultural Revolution. There were certain new institutions of people’s committees and Red Guards to expand people’s democracy. But this experience was very short and after Comrade Mao died, the counter-revolution in China took place.

Now it is up to the revolutionaries of the 21st century to learn from those lessons of the 20th century and develop a new concept of proletarian democracy. Our party discussed this thoroughly and made a review of the positive and negative aspects of revolution in the 20th century. We came to the conclusion that though the basic concept of MLM on state and democracy remains valid, because the Soviet apparatus was no longer functional, when the Soviet state turned into a bureaucratic state, and with the lesson of Mao’s experiment of Cultural Revolution against that negative experience of the Soviet Union, we have to develop the concept of proletarian democracy further. Our conclusion was that basically we need more room for the masses of the people to supervise and intervene in the state. If that will not happen then after the revolution the initiative of the masses will be diminished, and only the few of the bureaucratic elite will rule over the state in the name of the proletariat and the revolution would not be carried further.

To check this we have to create certain mechanisms whereby the constant mobilising of the masses and the constant vigilance and intervention of the masses is ensured so the state doesn’t turn into a bureaucratic state. To create such an institution one of the ideas is to provide democracy as was practiced during the Paris Commune days, or to again go towards the Soviet model of democracy, or draw lessons from the Cultural Revolution. We want to take lessons from all these three experiences, so our party’s conclusion was that within a socialist framework, within the framework of the dictatorship of the proletariat, competition should be organised among the masses of the people, so the masses will be constantly energised and it will prevent only a few people having a monopoly over the state.

This concept of competition within the framework of socialism, of proletarian dictatorship, we have developed this basic concept. But this is only a general concept, the actual mode of that competition we have still to work out. Our general feeling is still under discussion, we haven’t reached any final conclusion. But we have proposed multi-party competition within the socialist framework. Why do we need many parties? Though the proletarian class is one class, the proletarian consciousness is different, there is uneven consciousness. If there is competition among them then the most revolutionary section will be in a position to lead this process through democratic means. All the masses of the working class can be mobilised, and in such mode of constantly mobilising the masses of people we will limit the chance of degeneration of this democracy into a bureaucratic set-up. That’s why we are thinking one of the options is to allow multi-party competition among the proletarian and progressive classes within the framework of the leadership of the proletariat and a socialist constitutional framework.

This is one of the options that we have proposed but it just a proposal, we haven’t reached any conclusion. This is what I discussed in that article, it is a preliminary article, we have proposed this but I think it needs to be discussed in the international proletarian movement and developed further. Otherwise we will not be able to draw lessons from the failures of the teachings of socialism and proletarian revolution in the 20th century and lead revolution forward into the 21st century. The basic point of departure is still from the Cultural Revolution, where Mao went beyond the traditional framework of the state system and gave more power to the masses of the people to rebel against the bureaucratic system within the party and within the state. That is the general orientation. But the right institutions have not been developed yet. The job of the revolutionaries in the 21st century will be to develop that concept further and to develop certain institutions and procedures whereby the proletarian class gets mobilised to carry forward the revolution. With this is mind, we are putting forward this concept of competition within the New Democratic and socialist state framework.

WPRM: Elections in imperialist countries generally serve not as a way to mobilise the masses but as a formal ritual that people carry out in a very bureaucratic way. Only very seldom does the election actually mobilise people and that is in very specific circumstances, like to some extent the election of Obama in the USA, because people were so opposed to the crimes of the Bush regime. How can you make elections at all for mobilising people and helping people develop their understanding of the class nature of society and the need to push towards socialism when our general experience of elections in imperialist and oppressed countries is that they are a tool for deceiving the masses?

Baburam Bhattarai: The practice of democracy in imperialist counties is a form of bourgeois democracy, a ritual that deceives the masses of people and perpetuates the rule of their class state. But what we are talking about is not organising elections within the bourgeois state, we are talking about after the revolution in a New Democratic or socialistic framework, where there will be certain constitutional provisions whereby the reactionaries, imperialists and criminal forces will not be allowed to participate. Only the progressive forces, the democratic forces and people will be allowed to compete. That is the competition within the New Democratic or socialist framework we are talking about. This is a basic difference. After the revolution, the first thing we will do will be redistribution of property. There will no longer be rich and poor, a big gap between the haves and the have-nots. That way when we organise competition there will be an equal chance for people to compete. But in the given framework of the imperialist and bourgeois democratic system there is a huge gap between the propertied and property-less working class. The competition is so uneven that the property-less working class can never compete with the propertied, the bourgeois and imperialist class. That way, only after carrying out this redistribution of property in a socialistic and New Democratic manner can you organise political competition where there will be a fair chance of everyone to compete on an equal footing. Our idea of competition in a New Democratic and socialist framework is therefore fundamentally different from the formal competition and practice in a bourgeois democratic and imperialist state. The difference in the class nature of the state should be appreciated.

WPRM: You’ve already discussed some aspects of the Cultural Revolution but I would like to go into that in more detail. The Cultural Revolution was the pinnacle of revolution in the 20th century, so what lessons do you and the UCPN(M) take from this?

Baburam Bhattarai: Yes we think the Great Proletarian Cultural Revolution was the pinnacle of revolution not only in the 20th century but in the whole history of the liberation of mankind. It is the pinnacle of the development of revolutionary ideas. So all the revolutionaries must make the Cultural Revolution their point of departure and develop the revolutionary idea and plan further.

The basic question of the Cultural Revolution was to continue the revolution under the dictatorship of the proletariat. That was the basic idea. So first you need a dictatorship of the proletarian class, and for that you have to smash the whole state and complete the revolution, that is the first thing we have to do. After the establishment of the dictatorship of the proletariat, the working class needs to be constantly mobilised in a continuous revolution. Only then can we prevent the state degenerating into a bureaucratic apparatus. That is the basic idea. That’s why after the negative experiences of the Soviet Union and the initial negative experiences in China, Mao developed this concept of Cultural Revolution, giving the masses the right to rebel. He asked all the oppressed classes and people to rebel against the authority in power and he introduced Red Guards, people’s committees, all-round dictatorship of the proletariat in every field, in politics, economics and society, in cultural space, exercising all-round dictatorship over the bourgeoisie to continue the revolution. This is the fundamental aspect of the Cultural Revolution and this needs to be upheld and developed further.

But in our case since our class has not completed any revolution in the 21st century and there is no revolutionary socialist state in the world, we have to draw lessons from the Cultural Revolution and try to practice them within the revolutionary parties and within the mass organisations, and then after we complete the revolution then we can practice the basic tenets of the Cultural Revolution in the state. This is the basic lesson to be drawn. And what we would like to stress is that without taking the Cultural Revolution as the point of departure we cannot complete the revolution in any country in the present day world and we will not be able to reach socialism and communism if we don’t have this idea of continuous revolution under the dictatorship of the proletariat. This idea of continuous revolution needs to be grasped very firmly. People generally think that once state power has been captured, the revolution is complete. But thinking like this means the initiative of the revolutionary masses will be diminished. That has been a flaw of earlier revolutions. What we need to practice now is the idea that the revolution never stops until all the classes are abolished, the state is abolished, the property system is abolished and we enter a classless and stateless society, or a commune of the masses of people is created. Until that stage is reached revolution never stops. This idea of Cultural Revolution needs to be firmly grasped and we are very serious on this issue.

WPRM: How do you practice Cultural Revolution within the party now?

Baburam Bhattarai: Within the party we allow broad and great democracy. The principle of the Communist Party is democratic centralism. We need centralism to guide the revolution, we need strong leadership, but if that leadership and centralism is not created on the broad foundation of democracy, that is not acceptable. Otherwise that leadership could degenerate into bureaucratic centralism. Right now within our party there are broad divisions on any issue, but the central leadership will mobilise the cadres and masses of people to discuss these issues and only then will the decision be taken. Once the decision is taken it will have to be carried out. But before taking the decision any issue must be broadly discussed so that the great exercise of democracy should be done first and on the basis of that the centralism will be created. Only that kind of centralism will be truly democratic centralism. This is what our party is trying to practice.

WPRM: What about the practice of two-line struggle within the party?

Baburam Bhattarai: Two-line struggle is also related to this question. Two-line struggle is the life of any party because everything is a unity of opposites in this world. Even the party is a unity of opposites. The policy of ‘one divides into two’ also applies to the party. So although there is a contention between proletarian and non-proletarian tendencies within any communist party, so there has to be a proper mechanism to organise a struggle of different tendencies within the party. Therefore two-line struggle needs to be promoted. The only thing is we have to be very careful in handling the two-line struggle. On this issue there are different tendencies within the International Communist Movement. One is very sectarian, once you enter into two-line struggle you always end up with a split. This is a sectarian or ultra-left tendency. The other is a right-revisionist tendency, which is to struggle and always compromise so that the party gets turned into a reformist group.

The correct MLM formulation is unity-struggle-transformation. We should struggle with the aim of achieving a higher level of unity. That’s the aim of the correct handling of two-line struggle in a revolutionary party. And our party has been very successfully conducting this method of two-line struggle with the aim of unity-struggle-transformation. We are interested in mainly transformation. If the aim is not transformation then it is not reaching a higher level of unity and then the two-line struggle always leads to a split. And a split of the proletarian party weakens our class and our ability to carry forward revolution. This lesson needs to be firmly grasped, especially among Maoist revolutionaries in the world today. In the name of carrying out two-line struggle they forget the aspect of reaching a higher level of unity and transformation. In that way the revolutionary parties remain as very small groups and collections and are not able to carry out revolution. I think these lessons, especially from Lenin and Mao, need to be drawn and practiced.

WPRM: As a way of concluding this interview, in the situation of continued pressure and the possibility of intervention from US imperialism and Indian expansionism in particular, do you think that socialism in one country can be developed in Nepal?

Baburam Bhattarai: This question of socialism in one country is a theoretical question to be debated. This is the era of imperialism and proletarian revolution. Imperialism always consists of uneven and unequal development, so revolution within a country is not only a possibility, it is a must, because revolution won’t break out all over the world at the same time. That’s impossible as long as imperialism remains and uneven development is there. This is a basic tenet of Leninism which still holds true and we should grasp it. But in the specific case of a small country like Nepal, sandwiched between the big countries of India and China and being dictated over by US imperialism all over the world, if you don’t have support, international support, or there is no strong revolutionary movement, it will be very difficult to sustain the revolution. It may be possible to carry out the revolution to capture state power, but to sustain the state power and develop in the direction of socialism and communism we will need support from the international proletarian movement. That way the level of international support and international proletarian solidarity is important. After the growing influence of so-called globalisation, imperialist globalisation, the reaches of the imperialist power have gone to every corner of the world. If there is no strong international proletarian organisation to fight against imperialist intervention and domination, it will be difficult to sustain the revolution in one small country.

Keeping this in mind, we must however make revolution in our country, this is a must. But to sustain it and develop it further we need the backing of the international proletarian forces. For that we have to give more importance to internet work and the international community. This need is more important in the case of small countries like Nepal. In fact, in recent months we have been discussing this issue. To complete the revolution in Nepal and sustain it and develop it further, at least in the South Asian context, we need to have strong revolutionary solidarity and we need the backing from the international proletarian movement. We feel the events of the international proletarian movement worldwide and some of the institutions that are being developed are all important, like the Revolutionary Internationalist Movement (RIM), the Coordination Committee of Maoist Parties in South Asia (CCOMPOSA) and the World People’s Resistance Movement (WPRM). These type of organisations are very important for the success of the revolution and to gather support at the international level for the success of our revolution.

Raipur Rally against Displacement, Oct 6 2009

The rally was organised by “Chhattisgarh Visthapan Virodhi Manch” (Chhattisgarh Anti-Displacement Platform), which issued the following leaflet before the rally:

RALLY OF ANTI-DISPLACEMENT MOVEMENTS FROM ALL CHHATTISGARH IN RAIPUR ON 6TH OCTOBER.

The unrelenting loot of the abundant mineral resources of Chhattisgarh – iron ore, coal, limestone, bauxite, and even diamond and uranium has meant the total stranglehold of big corporates – foreign and Indian – over the State’s bureaucracy, polity, and even judiciary.

Multinationals Holcim and Lafarge have gobbled up the Indian cement companies and persist in earning super profits from the illegal exploitation of contract labour; Vedanta can get away with, and is in fact ably assisted by the State administration in, the criminal cover up of murder by negligence of nearly a hundred workers in a recent chimney collapse; Jindal and Monnet specialise in managing the pollution control department and so the Raigarh district, labouring under black clouds, drying water sources and disappearing forest cover, sees public hearing after public hearing where the public is never heard and clearances are granted, (Jairam Ramesh honestly called these environmental public hearings “match fixing” by the companies); a rash of sponge iron factories – mushroom in Raipur; Tata and Essar, with a little help from Collector Sahab, manipulate gram sabhas in the scheduled areas in gross violation of the PESA Act and employ every trick in the game to coerce people to accept compensations for land.

And in Bastar, where the huge ground clearing of 644 villages for “development by mining companies” is being resisted by lakhs of displaced adivasis, living in the jungles and therefore declared “outlawed”, who are struggling for their lands and livelihoods, the State is preparing to launch a full scale war ( now there is even talk of air strikes and American assistance) .

For the toiling people of Chhattisgarh, particularly the peasants and adivasis, this integration into the imperial loot machine that is called ‘development’, has meant displacement on an unimaginable scale. The whole of Raigarh district is dotted with heavily polluting sponge iron, steel and power plants, lorded over by Jindal. In at least half the cases the displaced have not even received the paltry compensations that have been declared their due. Many blocks of this district are notified scheduled areas and in the near vicinity of Reserve Forests, yet…

Not an inch of Jashpur district, from where human trafficking is reported on a large scale, will be left if the prospecting licenses applied by for by Jindal, MCP Kolkata and other companies are granted. Even though the law specifies that the consent of both owner and occupier are to be obtained and Jindal admits in writing that they have not obtained such consent, the entire machinery of the State Revenue department has been thrown into coercing people to grant such consent. Thousands and thousands of square kilometres have been applied for, covering 32 villages of Kunkuri block and 19 villages of Bagicha block, another 7 villages of Jashpur block and so on….

In Kawardha, Bilaspur and Dhamtari, the Reserve Forests to protect tigers, elephants and even snakes are going to be doing away with the poorest of poor of the tribal people including primitive tribes. Lofty promises of alternative land and compensation are meaningless when land rights are not ensured to the tribals before they are displaced as specifically laid down in the Forest Rights Act….

Not that the affluent peasantry are being excepted. 41 and subsequently more, leading to a total of 65 villages, of Raipur district are to be displaced for a glittering new capital region. Of course an international cricket stadium, convention centre, five star hotel complex, gems and jewelry and IT SEZ, and the bungalows of our Hon’ble MLAs (one fourth of whom are now “crorepatis”) are very much “public purpose” enough to justify this displacement. Touts of all colours are working overtime to persuade people to accept that monetary compensation, which may look attractive in a situation of failing agriculture but cannot last beyond a generation, as their fate.

The villages trapped within industrial areas are seeing their communal lands being illegally occupied by companies, and the bastis of the contract labourers who work in those factories are always under the shadow of the bulldozer, deprived of the basic amenities of water, sanitation and electricity. After long struggles these bastis have been included in the municipal bodies and the workers recognised as “citizens”. The villagers of village Chourenga which continuously resisted the setting up a sponge iron plant, are still rotting in jail on false murder charges.

In Rajnandgaon 7 villages are to be displaced for an airbase, presumably part of the State’s war preparations; and in the Raipur-Bilaspur belt, rich in limestone, a number of cement plants are to come up. The earlier bitter experiences of peasants of getting only temporary and contractual jobs during the construction period of plants and then in fact being pitted against outside workers has led to enormous tension with the unemployed rural youth. This is despite the State’s official rehabilitation policy which stipulates only permanent jobs as adequate compensation. Fertile and multi -cropped land is being acquired for the private profit of companies without even a thought of the social costs.

The Gandhian NGO Vanvasi Chetana Ashram which is trying to implement the recommendations of the NHRC to rehabilitate the villagers of 644 villages that have cleared out during the recent “salwa judum” campaign has faced demolition of their ashram, attacks and false cases on their karyakartas under the draconian Chhattisgarh Special Public Safety Act.

In every corner of the State, people are struggling against displacement.

Over the last four months about 20 grass roots peoples organisations from many districts all over Chhattisgarh – Raigarh, Jashpur, Bilaspur, Raipur, Rajnandgaon, Dhamtari, Dharamjaygarh, Dantewada and Korba have joined hands to form a loose front, cutting across traditional party lines, called the “Chhattisgarh Visthapan Virodhi Manch”, which is still growing.

This “Manch” is holding a rally in the capital city Raipur on 6th October, against all odds – despite its constituent organisations being poorly off, and having to brave the use of money power and muscle power against them by the companies.

We also know that the companies will be trying to “manage” the media.

Please come and cover the event, and bring out the voice of the affected villagers from all over Chhattisgarh.

A Sensible Democratic Alternative to the Proposed Military Offensive

The government’s proposal for large-scale military offensive in Central and parts of Eastern India has been opposed by democratic minded people from across the world. Democratic sections of civil society in India have called for an immediate halt to the government’s military offensive. They have argued that the conflict be resolved through negotiations between the government and the CPI(Maoist). In response, the Home Minister has stated that in a “democracy”, such negotiations can only be held if CPI(Maoist) “abjures violence”. This is, to say the least, disingenuous. As these sorts of conflicts are by definition “asymmetrical”, and since the military might of the Indian state is incomparably superior, it is the responsibility of the government to take the first steps to win over the confidence of the adivasis and the rebels by calling off the military offensive. When the government is sending in thousands of paramilitary troops, encircling key areas and continuing military action on the rebels, asking the rebels and the people to give up arms as a precondition for negotiations, is certain to ensure that no negotiations take place.

Therefore, in order to gain the confidence of the common people that the government is sincere in its intention to end the conflict through negotiations, it needs to take at least the following concrete steps.

1. The military offensive must be immediately and unequivocally called off and all military and paramilitary from the forested and semi-forested areas of Central and Eastern India must be withdrawn. Moreover, in order to create a genuine atmosphere of trust, all state agencies should stop issuing threatening and hostile statements against the CPI(Maoist) and stop harassing its activists and sympathizers. The CPI(Maoist) should also, on its part, reciprocate by suspending all armed activities and desist from issuing threatening statements against anyone.

2. The Unlawful Activity (Prevention) Act and Chhattisgarh Special Public Security Act must be repealed. Also, specifically, the ban on CPI(Maoist) by the government of India should be lifted and the CPI(Maoist) and its frontal organisations, if any, should not be banned by creating some new laws. Political prisoners jailed or in custody for being involved with so-called left extremist activities and hundreds of adivasis/non-adivasis imprisoned using fabricated charges need to be freed unconditionally.

3. All Memoranda of Understanding (MoU-s) signed with different corporations, for the extraction of natural resources from the vast areas of East-Central India, must be revealed and immediately canceled.

4. Salwa Judum and similar bodies must be disbanded. A tribunal be appointed to investigate their atrocities carried out in connivance with the police, para-military forces and government agencies.

5. Negotiations must not be used as a ruse to liquidate activists of the CPI(Maoist) or any people’s movements. To ensure this, the Central and concerned State Government should submit an undertaking to a mediating body, composed of representatives chosen by the government and the CPI(Maoist), that no encounter deaths, armed actions, espionage activity would be carried out during the mutually agreed upon ceasefire.

Most importantly, we reiterate that the crux of this conflict is the neo-liberal model of development pursued by the Indian state, which has been threatening the life and livelihoods of the common people. The government’s declaration that developmental packages will follow the victory over the rebels raises fear that it has plans ready to roll in the kinds of “development” that suit the interests of multinational and domestic big corporations once these regions, rich with natural resources, have been cleansed of political dissent and the entire population has been either killed or displaced and pauperized as a result of the military offensive. If the government does not have any such plans, it should immediately engage in dialogue with people of the regions along with the suspension of military operations.

6. Thus, a wide-ranging debate on the model of development for these regions must be conducted without any delay. Given the stiff opposition by the local population to the development model that is being pushed down their throats by the government, there should not be any attempt to implement any pre-determined “development package”. Rather, there must be a serious initiative to comprehend and document what measures constitute development in the eyes of the local population and what are the ways to implement these measures such that the people concerned are in primary control of this process. Any developmental process and its modalities must be an outcome of such discussions.

7. In view of the above scenario, the government should also immediately repeal the SEZ Act 2005 and stop all the projects that have so far been cleared. It should also address the concerns related to laws of acquisition of land for corporate interests. Moreover, the government must immediately cease all evictions and diversion of forest land, under the guise of industrialisation, resource extraction or conservation, and expeditiously settle rights to forest land and forest produce.

No to armed forces against naxalites

Janhastakshep, Campaign Against Fascist Designs, People’s Union for Civil Liberties (PUCL) and People’s Union for Democratic Rights (PUDR) held a public meeting “No to use of Army & Air Force Against Naxalites” on the 24th October, 2009 (Saturday) at Constitution Club, New Delhi. The meeting was attended by a wide spectrum of people from political parties, intellectuals and political activists such as Mr. Surendra Mohan, Prof. Manoranjan Mohanty, Shamshul Islam and many others. Many attendees had to sit at the aisles because of the large number of people who had come to attend.

Noted poet Pankaj Singh gave the introductory note, he emphasized on how the state and ruling parties are seriously attempting to distort our perceptions and notions in labeling the growing Naxal movement as “the single biggest threat to internal security”. The reality it is that it is the failure of the state and governance in India which are the biggest threat to the life and livelihood of millions and the army and air force are wrongly being used as means to resolve issues of bad governance.

Professor Randhir Singh emphasized, that those who condemn violence do not only condemn excesses but also demand an acceptance of the qualities of the current state. “Radical politics and extra parliamentary tools have to be emphasized, people have a right to choose their preferred method of resisting oppression. Today, the Maoists and Naxalites represent the dream for justice and a better future by those millions who have been marginalized by society and the ruling party’s plans to use the army to fight against them will be disastrous for the country”.

Retd. Admiral Tahiliani, former Chief of Naval Staff was adamant that The Army, Air Force and Navy must never be used against its own people and the government must take remedial measures to create a more equitable society with responsible governance. Denial of land rights to Tribal people, corruption and the failure of existing legal means of justice are solely responsible for growing discontent and violence.

Aparna, Secretary Delhi State Committee CPI(ML) New Democracy spoke on how Chidambaram and Manmohan Singh are wanting to unilaterally hand over India’s mineral wealth and resources for exploitation by foreign MNCs and big corporate houses. Aparna called upon the rest of India to also fulfill their “patriotic duty” in resisting such nefarious designs and also to beware of leaders like Chidambaram and Manmohan Singh who are attempting to obfuscate issues relating to allocation of resources within distorted, biased debates about ‘violence and non-violence’.
D. Raja, National Secretary CPI spoke on behalf of the CPI and A.B. Bardhan. He stated that the CPI was the first to give a strong No! to using the armed forces against its own people and also emphasized on the need to build a united front against state violence. Several states have refused to earmark funds for the development of ST SC’s and he stressed that it is neglect by the government and its anti people policies which are solely responsible for the alienating the tribal communities and growing violence.

G.N. Saibaba from RDF spoke about how this would not be the first time that the armed forces have been used by the state to oppress the people; in the 1950’s and 1960’s the army and air force was used in Telangana, and Mizoram and for decades the army has been used as an occupation army in Kashmir, Nagaland and Manipur. The difference this time is because the army will be deployed in the hinterland of India, not allowing the ruling parties the privilege of using ‘divide and rule’ or the notion of ‘us and the other’ which used for a long time through creating false communal and ethnic divisions. He emphasized that such attempts to stamp out dissidence will inevitably back fire and further unite the people in their struggle against exploitation and state violence.

Himanshu from Vanvasi Chetna Ashram Chattisgarh made a passionate appeal to the intellectuals and the educated middle class to come out in open defense of the poorer people, especially the Adivasis. He was categorical that no amount of killings or threats will prevent the people from standing up against oppression until the question of equity has been completely resolved.

Noted Advocate Prashant Bhushan sent a written note strongly condemning the plans to use the Army and Air Force against the people and Prof K.R. Chaudhary from Hyderabad also spoke at the meeting condemning the same. At the end of the meeting a resolution was unanimously adopted opposing the use of the Army and Air Force against Naxalites.

Maoists and the paradox of development

After opposing the industrialisation in Singur and Nandigram on the premise that the same is outrageous, inhuman and not ‘people oriented’, Maoists find themselves in an apparent dilemma to raise the issue of under-development in Lalgarh, the very next day.

Their illusion of an alternative path of development under capitalism with humanitarian considerations, leads the Maoists directly to the lap of reformism, as this means nothing but craving for a humanitarian face for capitalism. Fighting for this ‘soft’ capitalism, with humanitarian attributes, of course with arms in hands, the Maoists reveal themselves as ‘armed reformists’ or ‘reformist militants’ of a new type, but in essence the armed defenders of the same old capitalism.

Do you want to destroy capitalism? ‘No, not at all! We rather want to see the capitalism grow, as that is the only road to socialism. Our program is to liberate capitalism of the shackles of feudalism and Imperialism’! Maoist retorts. Thus, a ‘Capitalist road to Socialism’, this is what the program of ‘new democracy’ means in essence to our Maoist!

This essentially reformist perspective of Maoists, is completely in consonance with the politics of petty-bourgeois peasantry, their actual social base, which though pulverised under the advance of capitalism, yet craves only for a ‘human’ face of capitalism and not for abolition of the bourgeois property relations, as a whole, as it itself, as a class, rests upon such relations. Maoists, the historical representatives of peasantry-the rural petty producers- thus do not and cannot overstep this limit.

But then the real difficulty presents itself in practice. As capitalism ‘grows’ it invariably grows through appropriation of petty producer, pushing it to the camp of the proletariat. Maoist is however not ready to swallow this bitter pill of capitalism and opposes the appropriation, e.g. in Singur and Nandigram. They defend the petty owner of land against this ‘inhuman’ appropriation and thus oppose the capitalist growth, with arms in hand. But then in the next breath they stake their leadership to Lalgarh movement which poses the question of ‘under-development’, demanding extension of capitalist development, the factories, schools, hospitals etc. etc on their virgin territory.

Thus, aiming for proliferation of ‘capitalism’ in their fancied program of ‘new democracy’, instead of its destruction, Maoists take offensive against the growth of capitalism, its penetration onto the virgin lands like Singur and Nandigram, while simultaneously they demand capitalist development in the underdeveloped regions like Lalgarh.

The paradox of ‘development’ for Maoists is that they are not sure if they are ‘for’ or ‘against’ the capitalist development as a whole. It is because they rest upon the intermediary class-the peasantry-standing with two faces: one towards the bourgeois and other towards the proletariat.

In fact, this paradox of development can only be explained in terms of inbuilt mechanics of capitalism leading to an ‘uneven and combined growth’, but then the resolution would lie not in ‘proliferation of capitalism’ but essentially in its destruction. But for Maoists ‘capitalism’ is sacrosanct, as they have learnt by rote from Mao himself, that proletariat cannot overturn capitalism in backward countries and has to pass through a ‘new democracy’ where capitalism has to be preserved, at any cost. The task for Maoists thus lies in liberating capitalism of its ills and not in liberating the working classes from capitalism itself. In their view, bourgeois not being a good manager of capitalism, destiny has assigned this task of management and cure of capitalism to Maoists. They, thus come forward not as hostile enemies of capitalism, but with their claim as better managers of capitalism. Capitalism under the management of Maoist Bonaparte, the red bureaucracy, is the real essence of ‘new democracy’.

The difficulty of Maoists lies in their flawed perspective of Stalinist ‘two stage theory’, which stops short of aiming for destruction of capitalism. This suicidal formula has already derailed the mature revolutions in China, Spain, India, Iran, Iraq and more recently in Nepal. In the name of ‘new democratic stage’ Maoists refuse to aim for destruction of capitalism, rather advocate its ‘proliferation’ during the new democratic period. This is what was professed by the 1940 pamphlet of Mao-tse-Tung, ‘On New Democracy’. In their view national capitalism has not lost its progressive vigour as a whole. While sections of national capitalism retain a progressive role, in their opinion, it is only imperialism and the comprador capitalism tagged to it which is reactionary. This way, Maoists attempt to segregate the feudal reaction on the one hand and comprador capitalism on the other, from the ‘national capitalism’ as targets of their ‘peoples war’, and thereby create illusions for progressive role of capitalism. They de-compose world capitalism, to get fragments of ‘national’ and ‘comprador’ capitalism and ‘feudalism’ separated from each other, in their laboratory of ‘new democracy’. By not targeting capitalism as a whole, and by sparing its ‘national’ sections, the Maoists not only betray the class whose red banner they hold, but themselves land into a dilemma.

‘Capitalism today, Socialism tomorrow’, is their battle cry, where ‘tomorrow’ is never to present itself to the proletariat!

This very limited political program of Maoists, especially in the age of grown-up Imperialism, instantly becomes a premise of apparently self-contradictory ideas, leading to nowhere, but into a trap of capitalism. Politically disoriented cadres, turned away from a political program against capitalism, are then left in a lurch, cheerleading for ‘armed’ actions of militants, kidnappings and beheadings etc. etc.

So far as advocacy of Maoists for National capitalism, against Imperialism, is concerned, the same is through and through reactionary. Imperialism has not appeared from vacuum, it has grown out of their cherished ‘national capitalism’. Maoists conveniently forget that National capitalism is nothing but pre-monopoly stage of world capitalism, which has gone far back in history, paving the way for Imperialism, the monopoly capitalism, which has since subjugated all forms of economy, national as well as foreign. National capitalism has been substituted by Imperialism in advanced countries, while in peripheral countries it has adapted to Imperialism. National capitalism is thus not progressive from any angle, in comparison to monopoly capitalism-the Imperialism, as our Maoists think, but it is vice-versa. Lenin in his debate against P.Kievsky has been categorically clear on this point:

…..But this Kievsky argument is wrong. Imperialism is as much our “mortal” enemy as is capitalism. That is so. No Marxist will forget, however, that capitalism is progressive compared with feudalism, and that imperialism is progressive compared with pre-monopoly capitalism. Hence, it is not every struggle against imperialism that we should support. We will not support a struggle of the reactionary classes against imperialism; we will not support an uprising of the reactionary classes against imperialism and capitalism. (A Caricature of Marxism and Imperialist Economism; Chapter 5. “Monism And Dualism”).

Working and toiling people suffer under capitalism, not only from its non-development, like in Lalgarh, but from its development too, e.g. Singur and Nandigram. The sufferings of people are thus caused by the dynamics of capitalist regime itself, and not by its growth or undergrowth. Maoists refuse to see this and harp upon the non-issues, in a petty bourgeois populist way. They beat about the bush, leaning upon this or that side of capitalism, and prevent the toiling people from realising that their liberation consists in destruction of capitalism and not in limited reformist program of support or opposition to its advance.

The whole viewpoint of Maoists, revolves around the pivot of intermediary classes and their ideas, chiefly the rural peasantry, while bypassing the industrial working class, the only class standing in opposition to capitalism. The mass following, Maoists claim to have got behind them, is the fallout of their debased policy, where they not only choose backward rural regions as their operating ground, but here also appeal directly to politically most backward sections, e.g. tribals, living in pre-capitalist conditions. These politically backward sections are the best audience for de-classed ideas, at least till the time the most advanced sections of the working class do not organise themselves under a revolutionary proletarian leadership, to lead in turn this backward mass against capitalism and on the road to a proletarian overturn. The absence of political consolidation of the working class in India, however, provides and would continue to provide, a very convenient breeding ground for all sorts of petty bourgeois ideas and organisations, including that of the Maoists.

Debate concerning the Lalgarh movement

The ongoing Lalgarh movement in West Bengal has accomplished many things. It has taken people’s movement on to a higher stage where resistance against state repression in various forms is tied up with the struggle for the development of the adivasi languages and script, a new pro-people model of development and a determined fight not to hand over the natural resources of the region to foreign and domestic big capital for plunder and loot in the name of ‘industrialization’. This historic movement has also led to controversy as to its nature, the nature of the involvement of the Maoists in it, the relation between the People’s Committee Against Police Atrocities and the Maoists and the problems faced by the civil rights bodies and various sections of the people in responding to the movement in the different stages of its development. Many articles have been published in the dailies from Kolkata, most of which are not available to people in other states. Since the debate is rich in content, we felt that the arguments and counter-arguments should be circulated among as many people as possible. This debate is good for the functioning of democracy, for dispelling wrong notions and helpful in forming/changing/modifying/strengthening one’s opinion. We have picked up three articles—all written in the form of open letters and responses. The first article is captioned ‘An Open Letter to the Maoists’ written by Sujato Bhadra, a well-known civil rights activist from West Bengal. The second and third articles are responses to that. One (the second) is captioned ‘Response from Jangal Mahal’ and written by Kishenji, the well-known and much talked-about Maoist leader now in Jangal Mahal; the other is captioned ‘Violence and Non-violence’ and written by Amit Bhattacharyya, Professor of History, Jadavpur University, Kolkata and human rights activist. These were published in the Bengali daily Dainik Statesman. The first came out on 26 September 2009, and the second and third came out in a single issue, that of 10 October 2009. The following is a free translation from the Bengali originals.

An Open Letter to the Maoists

The present writer is an Indian citizen, associated with the civil rights/human rights movement in West Bengal for some decades. You are probably aware of the fact that recently in this state your armed activities and the more violent and more cruel repression subsequently adopted by the state by making your activities as a pretext has given rise to a debate.

As you know, the civil society became vocal in its criticism of police repression and terror in the Jangal Mahal area including Lalgarh in last November (2008). The charter of demands placed by the People’s Committee Against Police Atrocities got the wholehearted support from the civil society and many organizations. The civil society was conscious about the happenings that took place since 18 June; it raised its voice time and again against repression perpetrated by the joint forces, stuck to the demand for the withdrawal of joint forces and placed demand to the government for sitting in a dialogue with all the parties. We have strongly opposed the ‘terrorist’ tag being affixed to your organization (by the state). The dissident part of the civil society was also much vocal demanding the repeal of the UAPA. In a nutshell, the position of the civil society against state repression and terror is zero tolerance. Many of us are in no way subscribers to the ‘Ticking bomb situation’ model.

The basis of our protest is our adherence to democratic values, consciousness emanating from humanitarianism and morality. Such elements, we feel, should also become part and parcel of politics guided by class outlook. It is these thoughts that have made me feel that some of your activities suffer from lack of logical thinking. Some events even severely hurt out consciousness and gave us pain.

Your party was confronted with such questions earlier also. You have replied to the open letter from the ‘Concerned citizens’ of Andhra Pradesh, I have also gone through your reply to the questions raised (centring round Chhattisgarh) by some eminent persons (Ramchandra Guha and others). At that time you worked as an underground party. Recently, after the promulgation of the ban on you and the draconian black law, the situation, no doubt, has become more difficult for you. Now there is no legal avenue for us to know your views and to respond to them from our side. We appreciate the fact that you have to carry on in the face of such a suffocating atmosphere and state terror. While sharing your anguish, I bear doubts about some of your activities. I am placing those things, keeping in mind the difficult situation you are in. My request to you is to give these (critical observations) some consideration.

In one of your leaflets on ‘Maoist violence’, the following is stated: “…violence has a class-orientation, it is never neutral…only armed struggle and people’s war would develop and spread people’s democratic struggles…our work in not violent, it is people’s violence to get rid of violence, which is part of people’s war” (dt.18-07-09).

I do not subscribe to this political view. I am not even opposing this standpoint from an alternative political outlook. I, on the contrary, would raise questions by keeping myself within your logical structure: one can talk about notion of violence and deal with it at the theoretical plane; problems crop up at the time implementation and the social impact that necessarily follows from it. It is related to the intense reaction that has been generated within the supporters of Lalgarh and other democratic movements.

Why only you, many philosophers throughout ages had clearly maintained that justice could be established through violence only(?). For example, Sartre has written: “Violence is acceptable because all great changes are based on violence” (The Aftermath of War p.35). He forgot to add that history itself had shown that a society created through violent means could not live for long. Whether anything good can be achieved through violence is also very much doubtful. The concept “End justifying the means” rejects the notion of justice and morality; and the result is that “the means outweigh the end”.

You have declared in quite unequivocal terms that the heroic people of the area (Jangal Mahal) under the leadership of the CPI(Maoist) conducted trial in people’s courts and meted out to those lumpens (hermads of the CPM) the punishment they deserved for being police informers (Press Release dt.16-08-09).

Our opposition is over the question of this capital punishment. Many people and civil rights bodies throughout the world including India mustered public opinion for the final abolition of capital punishment (legalized murder). As a result, the majority of the countries in the world (224 countries) have abolished death sentence. The reason is that as a form of punishment, this practice is barbarous and cruel. Over and above, it also does not act as a deterrent. Beheading does not allow the victim any chance to rectify oneself. Not only that, there could also be possibility of error in judgement. If it is found after carrying out the punishment that the condemned person was innocent, nobody can return his life. On the contrary, such violent punishment makes the society more inhuman and more violent. Long time back, Tom Paine remarked: “The people by nature are not violent, they only reproduce the cruel methods used by the state”. We strongly oppose this cruel method/means adopted by the state. Side by side, we also hold that if notions such as ‘eye for an eye’ or ‘life for a life’ take root in the minds of the oppressed people in this unequal and deprived society, then there is the outburst of violent mentality from the side of the people; this is happening now. You represent the advanced elements striving for social transformation. What should be your role as the vanguard? Will you submit to that violent emotion, or will you uphold advanced democratic values and guide the people under your influence along that path?

What is the organizational structure of the ‘people’s courts’? Is it that the accusers themselves are judges and they themselves are the butchers? It is important to remember that in the judicial system set up by the state, there are certain recognized stages, judicial procedure, regular and separate judicial structure, a higher court of appeal and the right to clemency in the hands of the president. Despite all these, we demand abolition of the system of legalized killing. How can we thus and from what democratic, human rights or the values of just trial accept such trials in ‘people’s courts’ and the meting out of punishment?

The armed forces in Jammu and Kashmir and the north-east think that all the people living there are ‘suspect’; they raise big hoardings to declare ‘Suspect all’. Are you not acting in the same way? In your judgement, each and every CPM supporter or individual is part of the hermad gang and engaged in spying for the police forces. Unless they surrender to the people, they would be given death sentence. Such a method could be the manifestation of your power; but it is devoid of sense of values. You have already meted out death sentence to many ‘informers’; nobody knows how many more will have to meet the same fate before the rest of the lumpens would surrender to the people. This is because everything depends on what you think about it. You have stated: “To set those lumpens free would mean handing over the struggling and revolutionary masses to the joint forces’ (Press Release dt.16-08-09). Let us state in the light of what the psychologist Christopher Bolas has said: “Every time the killer strikes, it is his own death that he avoids”. It means that such attacks come from a sense of fear and apprehension. The question is: if you have a social base in the area, then it is possible to socially isolate the informers. On the other hand, if your political opponents carry on ideological struggle, and they are physically liquidated by branding them as such, then it will appear that some type of acute ‘irrationality’ pervades throughout your activities. In reality, Lalgarh has become a valley of death, and from there the message of death is travelling round. Is there no way to combat espionage other than liquidating them? Could not the people adopt the method of exposing those informers under your leadership? Marx had to close down his Das Kapital write a whole book named Herr Vogt in order to expose espionage. And Mao was in favour of beheading only a few.

In that case, propaganda and exposure will, on the one hand, not exert any negative social reaction, and, on the other, the state will also not able to get any illegal but apparently social sanction to ‘liquidate’ you. If that is not done, then we will be faced with a terrible situation: unmoved, indifferent human mass. In a situation attended with violence, counter-violence, repression and counter-attack, it will not be possible to mobilize democratic people and raise the voice of protest. We belonging to the third force (those who are neither with the state nor with you ideologically) would find ourselves in a helpless situation. Had we been able, as an alternative, to unite and create a tide of democratic movement against the ruthless state repression in Lalgarh, then we would have found in our ranks that civil society which was imbued with democratic values and inspired by the teachings of Singur and Nandigram, and thus would have ensured the victory of the weak over the strong. In the initial period (November ’08 to June ’09), it was in fact achieved.

You have passed your judgement on some eminent persons and decided to mete out death sentence to them. As you stated, it was the demand of the people. There was an attempt on the life of the chief minister through the Salboni blast. It is true that the chief minister is accused of committing genocide. It is also true that after 14 March massacre in Nandigram, posters and placards were raised demanding ‘Hang the chief minister”. But all of us realized that such outbursts were the manifestation of immediate intense emotion. But if that is interpreted as the serious, logical demand of the people to kill him, then, I am forced to state, this is totally childish. To brand someone as ‘authoritarian’ and then to attempt to kill him, is equally ludicrous and manifestation of anarchist philosophy. Let us remember that Marxist philosophy was established in the world by negating anarchist philosophy. Whether there is any philosophical or theoretical recognition of such individual-centric attack from Marxism to Maoism is not known to me.

Mao Tse-tung’s favourite military strategist Karl von Clausewitz wrote that like politics, war also has a specific aim; but that war at the same time negates that politics; the contending parties get busy parading their forces. War and annihilation bring destruction, but that not only to the enemy, but also inflict severe damage to your own side. And there is also no end to this war.

Friends and foes act always by treating each as a ‘unholy force’. The question is; while getting rid of the unholy, we ourselves are getting influenced by that force. We should not forget that great note of caution: ‘Whoever fights monsters should see to it that in the process he does not become a monster. And when you look long into an abyss, the abyss also looks into you” (Beyond Good and Evil). Counter-violence, counter-attack—these are the natural reactions of human beings. That does not require any special kind of philosophy. Philosophy, on the other hand, can control that reaction with logical thinking, can make human values and notions about morality indispensable elements in formulating policies. I feel that you suffer from serious limitations on this issue.

In the recent period, the police arrested two of your important members, but did not produce them in the court in time. Through your press release, you had quite rightly claimed that the police had violated law by not producing them in court within 24 hours and appealed to civil rights bodies for intervention. You have rightly thought about fake encounters. In the face of a public outcry, the police were forced to produce them in court. Before that, you have also made appeals to the intellectuals to come to Lalgarh to see with their own eyes the barbarity perpetrated by the joint forces in Lalgarh.

By doing so, you have admitted that if, even within this structure, the process of ‘rule of law’ is kept operative in the proper manner and if democratic voice is raised in its support, then it is possible to resist in some cases the illegal, anti-human rights activities and bad intentions of the state. Should it not be our task to strengthen all democratic forums of this type, so that it is possible to ensure the implementation of state-declared commitments to safeguard civil rights of the people? The more such space widens, the more will it be possible to prevent fake encounters, the killing of struggling people and to isolate and defeat the ‘Culture of impunity’.

If instead of doing so, we kidnap someone, oppress him and after that kill him and throw his body in the streets, then we ourselves become oppressors like the state. You will have to accept responsibility for the trauma that the children undergo when murders take place before their very eyes. Such a brutal method of murder can never be accepted by the sensitive people. How can thus we be able to enable people to dream of a society based on human values in place of the ugly face of the state? How can that dream be fulfilled by following the same condemnable, mean method?

You have claimed that Jangal Mahal has posed the questions to the whole people: “Would you support the repression by the joint forces in Lalgarh, or would you support the resistance and protest movement of the heroic people under the leadership of the People’s Committee Against Police Atrocities against the joint armed forces and the resistance forces including the hermads?’ (Statement dt.16-08-09). You have made appeals to all to stand by the side of the Lalgarh movement.

Many of us have consistently been supporting the movement against police atrocities and the demands of the Lalgarh people unconditionally. That is not the question. Many of us also do not consider your extension of support to that movement to be unjust.

The problem has started with the transformation in the character of the movement. It relates to your practice of violence. Needless to say, you have been using the typical Marxist ‘binary’ model of seeing it as a contradiction between the two—either one is on this side or on that side or on the side of the enemy; none among you is prepared to accept the fact that there could also be third, fourth or fifth position and stand by the movement. Scholars have written so many things on this ‘history of seeing’!

We are condemning the continuous state violence and the repression perpetrated by the main ruling party in this state. Along with it, we have also felt that that your declared presence has pushed into the background the focus of the direction of people’s upsurge and movement under the leadership of the People’s Committee. On the other hand, there are some negative elements inherent in the armed resistance under your leadership that stand in the way of getting mass support against state violence. Whether you realize it or not, we do not know. While standing in the 21st century—an era of human rights consciousness, in any resistance movement, particularly those with arms, certain universal unchallengeable notions, which we may call ‘minimal absolutist view’, should have to be recognized. Discarding those notions as ‘bourgeois’ at the time of formulation principles would only be suicidal.

Response from Jangal Mahal

The human rights movement in Bengal started in the early 1970s after the setback of the Naxalbari movement. The next few decades were one of vacuum in the revolutionary movement; it was in that context that human rights movement developed.

The human rights movement played a glorious role for four decades, standing by the side of oppressed masses. In those days, Sujatobabu stood in the forefront of that struggle. Civil rights movement in those decades took some shape. That model was the model of standing by the side of the oppressed masses.

However, as there was a resurgence of revolutionary movements in Andhra Pradesh and erstwhile Bihar in the 1980s, civil rights movement, by degrees, was beset with a crisis. That was the time when the masses rose to shake off the image of ‘oppressed masses’ and asserted their identity as the ‘resisting warrior masses’. Thus old model of civil rights movement could not fit in the new situation. The state started clamping down on human rights activists to keep the movement within specified limits. That gave rise to debate and contradiction within human rights movement. The glorious representative of human rights movement at that stage in Andhra Pradesh was Ramanathan R. Purushottam.

Human rights movement in Bengal still remained untouched by that crisis. This is because revolutionary movement in Bengal, as yet, had not regained its relevance in the political scenario.

Today the movement in Lalgarh-Jangal Mahal has raised a question before the human rights movement. Will the civil rights activists, who are accustomed to stand by the side of the ‘oppressed masses’, equally not be successful in standing by the side of the ‘resisting warrior masses’? The movement in Lalgarh-Jangal Mahal has brought to the fore two main questions:
1) Should the people’s movement, in the last analysis, be allowed to be exploited to make room for mainstream leaders/lady leaders? Or will the people be able to channelize it in a way that helps in the resurgence of the people themselves?
2) Should the people fighting against fascist rule be satisfied with saving their skin by holding the hands of leaders/lady leaders along the constitutional path? Or will the people protect themselves by destroying the fascist fortresses like that of Bastille?

Violence or non-violence? This had never been an ‘issue’ in Indian politics. What is called ‘democratic politics’—the practice of violence in that mainstream constitutional politics far surpasses the practice of violence in revolutionary politics. Thus in the language of law, this is a ‘non-issue’. It is to bury the two main issues raised by the Lalgarh movement that the state policy-makers’ circle has put forward this ‘non-issue’.

The right to self-defence is recognized even in bourgeois law. The right to kill the attacker for self-defence is recognized, though that right is used as pretexts to kill revolutionary masses and revolutionaries in the hands of the state. But when the oppressed masses turn into resisting warrior masses and come forward to exercise that right, the whole context changes.

What is meant by fascist rule? It is rule by a coterie of a handful of political leaders and bureaucrats. At the grassroots level, it takes the form of combined terror perpetrated by state forces and Gestapo forces of the party.

Let us keep in mind that fascism is a well-organized centralized system. Even if there is any loophole, then fascist system would penetrate through that loophole into the village and bring with it murder, rape and destruction of houses by fire. The right of self-defence of the masses demands that no shadow of the hermads exists in the villages, no loophole is allowed to be created through which they could penetrate any time. Today we are witness to the hair-raising serials associated with genocide, terror, rape and house-burning like Hitler’s Gestapo forces in the wake of the emergence of ‘salwa judum’ in Chhattisgarh, ‘Nagarik Suraksha Samiti’ in Jharkhand and ‘hermad forces’, ‘ghoskar bahini’, ‘Santras Protirodh Committee’ in the Jangal Mahal area of Bengal. These are part of everyday life–the operation by the joint forces, the setting up 80 to 90 bunkers, big hermad camps, with modern weapons like LMGs under police protection around Keshpur and Gorbeta to recapture Jangal Mahal. All these are known thanks to the media. On the other hand, the state is moving with moneybags from one village to another to create an informer and covert network, the police forces are creating a terror by beating up people indiscriminately, all the schools have been converted into police camps and thereby a war situation is being created. In such a war situation, can the yardsticks of just principles remain the same? Can the yardstick be the same for a normal situation and a situation when fascism rules? Civil war and fascism bring changes in human lives. The notions and yardsticks about just principles also undergo changes temporarily.

In order to tire out informers, the people are adopting a number of methods. On the other side, the state is also trying everything in its power to whet their greed. Thus the number of informers being killed is also mounting. Had there been some proper system in Jangal Mahal today, the number of informers getting killed would have been far less. In different parts of Dandakaranya, informers are being detained in people’s prisons.

As long as the joint forces did not enter the area, no need was felt to liquidate the spies in such a large number. After the intrusion of the joint forces, the situation has changed. Likewise, the notion of self-defence has also changed.

We are also opposed to death sentence. However, the notion of just principle in a normal situation is different from that in a war situation. In the war situation, freedom of thought, consciousness, initiative and innovation is much limited in scope.

Sujatobabu has observed: “Your pronounced and armed presence has pushed the focus of the speed and movement of people’s upsurge led by the People’s Committee to the background”.

Sujatobabu! The state has snatched away your right to openly enter Jangal Mahal area with only one objective. That is to indulge in disinformation campaign. Had it been otherwise, you would have been able to see that everyday thousands of people have been taking part in processions, mass gatherings, gheraos and demonstrations in every nook and corner of Jangal Mahal. Despite repression by joint forces, the system initiated by the People’s Committee is giving inspiration to the people. The creativity of the masses has increased even after the arrest of Chhatradhar Mahato. You would have seen how irresistible people’s movement has become. The inherent strength of the people’s movement, people’s initiative, their intense consciousness have truly been instrumental in writing the epic of struggle. If you are willing, we are ready to arrange everything for your visit to Jangal Mahal and provide security. Come, see with your own eyes, put them in writing, change your outlook. And turn upside down the frontier of human rights movement.

When the decision to form central coordination to take steps for curbing the Maoist movement and to silence 100 top leaders is taken and when the retired DG of the BSF, Prakash Singh openly expresses his displeasure with such a move, it shows that the state has been waging war, and war has to be fought in some particular way. In order to counter the decision of the state to silence top 100 revolutionary leaders (Prakash Singh himself has explained what it means in police parlance to make one ‘silent’), the need to take military action against top leaders of the state arises.

Sujatobabu, has stated that no change achieved through violent means has ever been long-lasting. We are not giving his remark much importance. We do not feel that he himself seriously believes in it. Most of the epochal changes in history could not be accomplished without violence. It was through violence that the ruling dynasties of the medieval age came to an end. Let me conclude by citing one example—that of slave Dred Scott against American slavery, the defeat in which made the civil war inevitable. It is the lust for power and property that made violence inevitable in all ages.

Violence and Non-violence

In the letter of 26 September (2009), captioned “An Open Letter to the Maoists” written by Sujato Bhadra, human rights activist, the author has completely messed up the cause and effect of the Lalgarh movement. In Lalgarh or Jangal Mahal, state repression was not the outcome of the ‘armed activities’ of the Maoists; rather, it was state repression, deprivation and sense of humiliation and years of pain and exploitation that has forced the people to support the ‘jungle party’, to become Maoists and to adopt ‘armed activities’ as the means of resistance and the realization of demands. What is actually implied in the author’s statement is that since armed resistance or counter attack would invite more severe state repression, it is better not to get armed at all.

The author then referred to the application of violence and the meting out of death penalty through trial in people’s courts. Here he has harped on several issues.

What transpires from his statement—and that I also the view of many others—is that ‘democratic’ struggle should be peaceful, and, if takes a ‘violent’ turn or gets ‘armed’, then it would lose its ‘democratic’ character and become an undemocratic one. The question is: is it a fact that only peaceful movements are ‘democratic’? And if it is ‘armed’ and ‘violent’, then it becomes ‘undemocratic’? What do History and practical experience tell us? Generally every person (barring the ruling clique and their faithful servants) wants peace, wants to have food and clothing and live in dignity; nobody wants violence or bloodshed. It is the repressive state that forces them to take up arms.

One of the main features of the Lalgarh movement is armed resistance (with firearms and traditional weapons) in the face of violent attacks launched by the state. There the state is waging a war against the people and the people in their turn are keeping up resistance to the best of their ability. Some CPM cadres and hermads have been killed. The Maoists declared that all of them were police ‘informers’; that they were warned before, but did not listen, so they were given death sentence in people’s courts. Whether they were police ‘informers’ is not known to the present writer. However, what is quite clear is that during the last 32 years, the gap between the ruling CPM and the police administration has vanished into thin air. Two years back, when female members of the Nari Mukti Sangha had been sticking posters in the Bagha Jatin railway station, they were encircled by CITU/CPM cadres, taken to the party office and then handed over to the police. During the same period, the members of the women’s wing of the CPM and some cadres tried to hand over five members of the Matangini Mahila Samiti residing in Jadavpur, Kolkata to the police. These mean attempts prove that the CPM cadres were playing the role of police informers.

The author is against death sentence. I believe, why only he, many people are generally against death sentence. His question is: as 224 countries have abolished death sentence, why should the Maoists still keep it as a form punishment? Here the author has committed a major error. This question is reasonable to countries and established governments; but how can it be applicable to those who do neither have any country nor an established government? The present writer is in total agreement with Sujato on one point: there should be thorough investigation before making any move; the loss of lives on the part of and damage to innocent people is totally undesirable.

In the opinion of the author, ‘a society formed through violent means is short-lasting’. My question to him is: Where at all has fundamental social transformation taken place and that too became long-lasting? Granted that in countries like Russia and China, where society was changed through violent means, there was change in colour. However, was the application of violent means responsible for those societies being short-lasting? Or was it due to the inherent contradictions in the new societies? History teaches us that fundamental social transformation did never take place without war and armed uprisings.

The author has raised the question of the social impact of violence. Why should he speak here only of some urban intellectuals who are detached from the struggle? What about the impact on the people of Jangal Mahal, those adivasi students who have been daily subjected to state violence? Would he not also talk about the resistance struggle by the people, of those people of the area who, like the people of Nandigram, have been spending sleepless nights and standing up to the challenge of the hermads and the joint forces?

The problem with the human rights activists is that they never challenge the existence of the state; on the contrary, they accept its legitimacy and demand that it should ‘put into practice its declared commitment’. Influenced by post-modernist thinking, they see only the tree, but fail to see the forest; to them, the Lalgarh movement is just a conflict between state repression and counter-violence perpetrated by the ‘armed opposition group’. But the lalgarh movement is at the same time a struggle against the plunder of the country’s natural resources by foreign capital and domestic comprador capital, a struggle for attaining pro-people development (setting up of health centres, construction of roads, dams and water reservoirs, implementation of land-to-the-tiller programme etc through people’s initiative and voluntary labour).

On 16 September last (2009), the English daily from Kolkata The Statesman organized a discussion on a theme captioned ‘Surely the Maoist is not one of us’. There in his speech, Prof. G.Hargopal said: “When a landlord takes away a villager’s wife, keeps her in his house to sexually abuse her and orders the husband to go away when he pleads with him for returning his wife to him and his two children, what is he supposed to do? Mouth platitudes about non-violence and peace? Or take up arms against a sea of troubles and by opposing end them? In one such case, a youth in Andhra Pradesh went straight into the jungle, organized a group of about 25,000 people, killed the landlord and ended up being Maoists”(The Statesman 17-09-09).

History teaches us that violence, murder—all these existed in the past and will continue to exist at present. All of us individually want peace; nobody wants violence or murder. Despite this, these will continue to stay irrespective of our wishes, and would influence the direction of History and leave behind their negative or positive imprint on the way.

Workers’ victory in Gorakhpur

Arrested leaders released, movement postponed after written assurance of implementing all worker’s demands within 10 days

Dear friends,

Under mounting pressure from the workers and the general public the district administration of Gorakhpur had to finally bow down and yesterday night (22 October) the administration was compelled to enter a written agreement accepting all the demands of the workers. The night before that (on 21 Oct.), the administration had unconditionally released all the four arrested leaders.

In protest against the brutal assault and arrest of the four leaders a strike was called in five factories of the Bargadwa Industrial Area on October 20 and more than 1500 workers started a dharna and hunger strike at the DM office. The district administration was under tremendous pressure after the announcement of “Citizens’ Satyagrah” in the city by the Citizens Front In Support of the Gorakhpur Worker’s Movement organised under the leadership of social activist Katyayani. An overwhelming number of striking workers braved the huge deployment of police, PAC, RAF personnel surrounding them and showed no sign of relenting. After a strong demonstration in the city on October 21, and under pressure from various civilian groups and organisations the administration released all the four arrested leaders after daylong hectic negotiations. But the workers continued their dharna and hunger strike demanding quashing of all false cases, action against officials guilty of beating their leaders and to conclude a written agreement meeting all their demands.

On October 22, the workers of two more factories joined the strike at the DM offce. The mounting pressure forced the administration for a written agreement to take back all the false cases, send recommendation to the state government to take action against the guilty officers and to address all the demands of the workers within a period of 10 days and the senior officers of the administration themselves made these announcements in front of the striking workers. After this the workers decided to defer their movement.

Under prevailing circumstances when the workers have been facing defeat after defeat against the combined force of industrialists-state-politician nexus, this victory of the workers of Gorakhpur is very significant. It could not have been possible without the extensive support of intellectuals, human right activists and labour organisations all over the country.

Apart from whole-hearted supported of activists and intellectuals of Gorakhpur, large number of writers, journalists, peoples rights activists and mass organisations of Lucknow, Delhi, Noida, Ghaziabad, Mumbai, Kolkata, Hyderabad, Patna, Ludhiana, Chandigarh, Allahabad, Kanpur, Varanasi, Badaun, Chhattisgarh, MP etc sent memorandums to the district and state administration, called the concerned officials to register their protest, issued statements and held meetings and demonstrations in our support. We have received hundreds of phone calls, emails and letters. We cannot reply to all of you individually right now, but we are grateful for your support and thank you on behalf of all the struggling workers.

However, we are not going to sit back and relax. We know by experience that despite the written agreement we will have to fight at each step with the administration and the factory owners to get the demands implemented. Discussion: “No to use of army and air force against naxalites”

Branding ‘left wing extremism’ as the most serious threat to internal security, the Prime Minister Manmohan Singh and Congress led UPA Govt. is unleashing serious onslaught on certain areas of the country where such forces are strong. Armed forces of the country are being pressed into this attack. Over 65,000 Special Forces are being trained by the Army for the purpose. While Govt. spokesmen are obfuscating the role of the Army in this offensive, armymen of Rashtriya Rifles and closely aligned ITBP are being thrown in. Air Force has been given permission for firing in “self-defense”. This last word is being added only to confuse the people. Where is the question of “self-defense” when Air Force is being asked to take part in offensive action? Air Force helicopters are being readied for attack and Air Force personnel “Garuds” are being given combat role.

Union Home Minister P. Chidambaram, who has been an advocate for Enron and a director of Vedanta, is articulating the strategy of “capture, hold, develop” against areas where Naxalites, to begin with CPI (Maoist), are strong. He is echoing US Gen. McChrystal’s Afghanistan strategy, essentially a strategy of occupation. In this vision development comes last and it has not come for last over 62 years. And it is even now being used to camouflage what is essentially a move to deprive the people of their rights to livelihood.

Along with this Army action goes enactment of black laws, indiscriminate arrests, torture, intimidation and fake encounters.

Prime Minister Manmohan Singh had underscored the need for this offensive in his speech in Parliament on 18.6.2009, “If left wing extremism continues to flourish in parts which have natural resources of minerals, the climate for investment would certainly be affected.” Thus he made clear that “left wing extremism” is the main stumbling block in his govt.’s vision for development i.e. for exploitation of mineral resources by foreign MNCs and big corporate houses of the country.

But these areas are inhabited by people, living and desiring to live with dignity. These are among the most oppressed people of the country. Their land is taken, livelihood destroyed and they are thrown into the wilderness of destitution, despair and hunger.

While the callous and criminal disregard of their concerns is glaring, the most appalling aspect is the use of Army and Air Force against citizens of the country. These should not be the forces used for the whims of those in power. They must not in any case be used against the people of the country. They are supposed to defend the borders of the country and not to kill, maim, intimidate and subjugate its own people. The action of the Govt. is bound to redefine the role of the Army and Air Force in the eyes of the people and the present Govt. has no right to do so. Progressive, democratic and peace loving people of the country reject this role to be assigned to the Army and Air Force.

WE SAY AN UNEQUIVOCAL NO TO THE USE OF ARMY AND AIR FORCE AGAINST THE PEOPLE OF THE COUNTRY IN ANY NAME AND UNDER ANY PRETEXT.

Findings of fact-finding team into Sep 17-Oct 1 murders in Dantewada

Peoples Union for Democratic Rights

Till now, no substantive information has been given in the media regarding the Gachanpalli killings of 17th September 2009 (during Operation Green Hunt) and 1st October killings at Gompad and Chintagufa villages by security forces. Nor have any reports appeared regarding detentions and arrests of several young men on 1st October. Information regarding looting, burning and torture which accompanied these operations have also remained unknown. Also, that people have fled their villages, are living in make shift sheds in the forest has gone unnoticed. The fact that on both these days, security forces (Cobra, local police and SPOs and Salwa Judum leaders such as Boddu Raja) went on a rampage stabbing and killing people, looting, burning houses and forcibly picking up young men is the other side of Operation Green Hunt which has been carefully kept away from public scrutiny. In order to ascertain these facts, a 15 member fact-finding team visited Dantewada area between 10th and 12th October 2009. The team comprised members from PUCL (Chhattisgarh), PUDR (Delhi) Vanvasi Chetna Ashram (Dantewada), Human Rights Law Network (Chhattisgarh), ActionAid (Orissa), Manna Adhikar (Malkangiri) and Zilla Adivasi Ekta Sangh (Malkangiri). The team was initially denied permission and was repeatedly questioned and interrogated at Dornapal and Errabore police camps on the way. The team spent a night in Nendra village (a rehabilitated village) and met witnesses and victims from several villages and gathered testimonies from them. Subsequently, the team spoke to District Collector and Superintendent of Police, Dantewada. While a detailed report is in the making, some of the important and significant issues are given below.

17th September 2009

1. Gachanpalli murders: In the early hours of 17th September, 6 villagers were murdered by security forces in this village. Dudhi Muye (70 yrs) who could hardly walk was murdered after her breasts were cut off. Family members who had fled the scene on seeing the security forces, found her lying dead in a pool of blood. Similarly, Kawasi Ganga (70 yrs) who could barely see was stabbed and murdered in his bed. He too was found by his family members who had fled from the house and had taken shelter in the forest. Madvi Deva (25 yrs) was tied to a tree and shot at three times and then beheaded. His grandfather who was accompanying him back to the village was a witness to this. The family hasn’t found his body. Three other villagers, Madvi Joga (60 yrs), Madvi Hadma (35 yrs) and Madkam Sulla were stabbed and murdered. The last two were killed in front of one witness, the wife of Madkam Sulla. Madvi Joga was killed after being stripped naked while ploughing his little plot of land. All the houses were ransacked, broken and burnt down. Family members are either living in sheds in the forests or have taken shelter with relatives. Many others have also taken similar shelter as their houses were burnt down by the security forces.
2. The case of Madvi Deva: This young man was a resident of Singanpalli village and had gone out in the morning of 17th for some family work. When he did not return his family searched for him. Two days later, a Patel from another village informed the family that he had been shot and killed by the security forces and his body was buried in the compound of Chintagufa PS. The Patel was asked to supervise the burial in the PS.
3. Burnt in hot oil: Muchaki Deva (60 yrs) of Onderpara was grazing cattle on the morning of 17th September. He was caught, beaten and dragged into the village by security forces. He was hanged upside down from a tree and a pot of hot oil was lit below and he was dropped into it. He was then pulled out and poured over with water. As a result, the upper part of his body is severely burnt and he has developed maggots in his wounds. He is still gravely ill and has no access to medical aid. Needless to say, he is afraid to leave his village.
4. Tied and paraded: 6 villagers, including 3 women were tied and paraded through Gachanpalli and other villages where the security forces went. Fortunately, they escaped as timely rains made it possible for them to flee.
5. Forced displacement and terror: families of those who were murdered by security forces and those whose houses have been burnt down vengefully, have fled the village and are living in make shift sheds in the forest. The condition of the others is no better as the entire village has been terrorized by security forces.

1st October 2009

1. Gompad ‘encounter’: SP Dantewada described the operations in Gompad village on 1st October as an ‘encounter’. An encounter with a difference: while 9 villagers were killed by security forces in the village and their bodies were left there, no casualties were inflicted on security forces. This too the SP confirmed. 4 members of one family, Madvi Bajar, his wife, Madvi Subbi, their married daughter, Kartam Kanni and their young daughter, Madvi Mutti were stabbed and killed inside house. So too were two other villagers from Bhandarpadar, Muchaki Handa and Madkam Deva, who were staying the night over at Madvi Bajar’s house on their way home from Andhra Pradesh where they had been working. Another couple, Soyam Subba and Soyam Jogi were stabbed and killed inside their house. Yet another villager, Madvi Enka was stabbed inside the house and then dragged all over the village. Before leaving the village, the security forces shot him and left his body. All 9 deaths, like the ones on 17th September, were preceded by stabbing and the bodies were left in the village. When the team asked the SP about recovery of bodies from the encounter site, the SP stated that Naxalites had ‘taken them away’.
2. More killings: In Chintagufa, a 45yr old man, Tomra Mutta was stabbed and shot inside his house. On seeing the sudden arrival of the security forces, Tomra Mutta ran to protect his family. He was shot in the process. The team confirmed 10 murders that had taken place that day but there is apprehension that the total number of killings may be much higher as many villages could not be contacted or accessed. The SP confirmed that two sets of raid parties set off that day comprising of Cobras and local police. Hence, the details with the team do not give the entire and exact picture of how many villages were attacked and targeted.
3. Travails of a 2yr old: Madvi Bajar’s grandson was not spared. He is all of two and yet the security forces beat him, cut four of his fingers, broke his teeth and cut off part of his tongue.
4. 8 arrested and 2 missing: Ten young men between 18-32 years were beaten and picked up by security forces from Mukudtong and Jinitong villages on 1st October. Eight have been shown as arrested in a case that was registered on 3/10 at Konta PS under various sections of IPC, Arms Act and Explosives Act. They are currently lodged in Dantewada jail. However, two still remain missing. Female relatives who went in search of those missing at the Konta PS were harassed, made to affix their thumb impression on blank documents and driven away. When they returned two days later, they were abused, told not to return and informed that the men had been taken to an unknown place.
5. Looting and Burning of property and houses: As many as 9 instances of looting and burning by security forces were reported to the team. Unlike the 17th September killings which were followed by arson and burning of the houses of those murdered, security forces on 1st October looted homes. They took away paddy, pusles, brass pots and poultry from many homes. Money, ranging from 300/- to 10,000/- was stolen from these houses. Destruction of property, particularly burning down of houses was carried out in as many as seven instances.
6. Harassment and torture: Witnesses reported several instances of harassment at the hands of the security forces. In Gompad, one villager was caught and interrogated and then shot at in his leg. He managed to run away but still has the bullet injury and has had no medical treatment. In Chintagufa, security forces tied another man and made him walk to Injaram PS. They severely beat him and also attacked him on his toe with a knife. He was finally let off in the evening.
7. Presence of SPOs and Salwa Judum leader with security forces: Residents of Mukudtong village confirmed that the ‘raid’ party was accompanied by known Salwa Judum leader, Boddu Raja of Injaram camp and they recognised SPOs Pande Soma of Phandeguda village and Ganga of Asarguda village. Residents of Gompad village were able to recognize SPO Madvi Buchcha who belongs to their own village.
8. Forced displacement and terror: Several families are living in makeshift sheds in the forest area as their houses have been burnt down. Those who are unable to run and flee are living in terror in the villages and residents and relatives have helped them to repair their houses and have given them other support.

Conclusion:

While the team could only meet residents of some of the villages, there is apprehension that a much larger number of people were killed on both days in other villages. The same is true for instances of torture, loot and detentions. The clamp down on information makes it impossible to know what exactly is happening in distant and far flung villages. However, what is clear is that the operations conducted by security forces have compelled villagers to leave their villages, flee into the forests and/or take shelter with relatives in other villages.

The condition of those who are residing in their villages is precarious and vulnerable. Given that the government has not complied with the Supreme Court order on rehabilitation of displaced families (families which were displaced in the earlier phase of Salwa Judum violence), the new and current phase of violence by security forces has added to the crisis in these remote and inaccessible villages. Instead of rehabilitating people, the government, in the name of combating Maoism, is bent upon unleashing its lethal paramilitary forces and evicting people from their villages. It is imperative to immediately end to this policy of eviction and terror and enable people to settle in their villages.

Demands

1. That the government must accept responsibility for murders committed on 17th September and 1st October by security forces and file FIRs against those responsible. Further, the government must acknowledge all instances of torture, illegal detention and destruction of property. FIRs must be lodged in each case and compensation given in each instance.
2. That an impartial inquiry (comprising civil society representatives and representatives of organizations working in the area) be conducted into the incidents of murder and acts of arson, loot and torture on 17th September and 1st October by security forces. The focus should be to bring out the truth behind these killings an also investigate the extent of the operations carried out on both days.
3. That the government must immediately take steps and show its conviction in the Supreme Court order on rehabilitation of villages and implement it immediately. The above described incidents of 17th September and 1st October have created fear and panic and compelled villagers to flee. Unless the government implements the SC order, villagers will not be able to live in their villages.
4. That along with the implementation of the above mentioned order, there be an immediate end to cordon and search operation carried out by security forces in these areas. Lack of rehabilitation coupled with an ever increasing size of the paramilitary forces in such backward areas with low population density raises fears of repeated incidents, such as the ones described above.

On the Workers’ Strike at Rico (Gurgaon)

Ajit Kumar Yadav, a worker in Rico Auto, Gurgaon was murdered by goons of the management. Four other workers were shot at and sixty others sustained injuries.

The management had been evading the workers’ demand to form a union for long. A month back sixteen workers were expelled in this regard and others (all 4,800 of them) were prohibited from working for engaging in ‘illegal activities’. Meanwhile, the management hired around 1,000 goons to prevent workers from coming back to work. In addition to this, the management’s goons, with the supervision of the police, brought around 300 workers from the unorganised sector to resume work in the factory. It should be noted here that these workers are not allowed to leave the premises of the factory and there are reports of torture by the goons. The workers sat in peaceful protest outside the main gate, demanding work and their unionisation. On October 19 the goons attacked the protesting workers and murdered Ajit, shot at four others and injured sixty. In response to this, more than 1,00,000 workers from more than 150 factories in Gurgaon participated in the strike on October 20.

The Hindu reported the incident on the 19th as ‘a clash between two groups of workers’. Such an explanation begs the question: Why should there be such solidarity amongst the workers if it was a ‘clash between two groups’? Furthermore, both The Hindu and The Times of India have lamented the fact that production has been affected. Whether it is the Maoist question or the incident at Rico, the media turns to the establishment to create a narrative. To understand this aspect of the media we need to locate its position as an industry in the capitalist system. There is a unity of logic that binds the media to the capitalist state. In times of need, notwithstanding their contradictions, all organs of the capitalist state come together as a whole.

This is nothing new. Workers have time and again asserted their right to determine their conditions of work. Workers’ agitation at the Honda factory in 2005 is not a separate incident. It comes from the same strain for self-determination. In Coimbatore, Pricol workers’ demand for the recognition of their unions is met with pressure from the management to withdraw from the road of struggle and sever ties with ‘Marxist-Leninist’/’Maoist’ forces. The unfortunate death of the Vice President of the Human Resources Development of Pricol Ltd in the workers’ agitation has lead employers and sections of the corporate media to demand a ban on trade union struggles and advocate labour reforms to give employers a free hand. A single day’s tragic incident is now being deliberately sought to be used to prejudice public opinion against the Pricol workers and suppress the truth of the nearly one thousand days of their united and determined struggle. Similarly, in Gorakhpur three activists and one journalist have been arrested for participation in workers’ demands for implementing labour laws.

When we condemn the Indian state’s war against the rural poor politicised by the Maoists, or express solidarity with people’s struggles anywhere, we see things through the prism of geo-political distance that separates us from them. True solidarity however will not exist unless we realize that though there is a distance separating us, and the forms of struggles that others engage in may not be relevant to our own context, the larger questions raised are the same. The struggle for self-determination and true democracy is one of which all of us are a part. A tribal in Chattisgarh faces the state in its most brutal forms, and as we see here, so does the factory worker. And to push it further, the student confronts the same state, may be in a seemingly milder form. Even as the above mentioned events were unfolding elsewhere, a multi-party meeting was organized on October 20 in Delhi University (North Campus) to take up the issue of fee-hike in colleges. The struggle is to ensure that we have a say in the decisions that affect us and to make sure that no decision that goes against the students’ interests goes unchallenged. All these are moments of contradictions when the facade of equality and democracy that the state covers itself with is exposed as a facade and nothing more. At these moments it is our task to make sure that the state does not go unchallenged, and that we recognize that each challenge to the state is part of our own larger struggle.

Petition against New Uranium Mining and Nuclear Power Plants in India

Madam,

We are writing to you on behalf of the National Alliance of Anti-nuclear Movements.

It is to protest against the reported decision of the government of India to take a quantum leap in installed capacity for nuclear power generation, from the current level of 4,120 MW to 63,000 MW by 2032. This decision is but an invitation to disaster.

In this context, we will like to submit the following.

Nuclear power, contrary to orchestrated hypes, is actually costlier than power from conventional sources like coal, gas and hydro. And once all the hidden costs are factored in, it would be costlier than even from renewable sources, like wind, in particular.

More importantly, it is also intrinsically hazardous, as large amount of radiation is routinely released at every stage of the nuclear fuel cycle. An even more intractable problem is that of safe storage of nuclear waste and safe disposal of outlived power plants, given the fact that the half-lives of some of the radioactive substances involved are over even millions of years.

Even more disconcerting is, considering the complexity of the technology of a nuclear reactor; there is no way to ensure that a major accident at a nuclear power plant will never take place. And a major accident, given the nature of things, will just turn catastrophic affecting a very large number of people, over a large territory, over a very long period. The disastrous accident at the Chernobyl nuclear power plant, in the Ukraine province of the then USSR, on April 26 1986 is a chilling illustration.

The promise of nil greenhouse gas (GHG) emission is also nothing more than a myth if the entire fuel cycle – including mining, milling, transportation and construction of the power plant – is considered.

Moreover, nuclear energy with its highly centralized power production model would only further aggravate the problem by accentuating the current development paradigm reliant on mega-industries and actively blocking any possibility towards ecologically benign decentralized development.

The strong linkage between nuclear power and weapons – in terms of large overlaps in technology, in turn triggering strong political push – of which India itself is a graphic illustration can also be overlooked only at our own peril given the genocidal, and suicidal, character of the nuclear weapon.

As nuclear power is economically unattractive and socially unacceptable, on account of radiation hazards and risks of catastrophic accidents, no order for new nuclear reactors was placed in the USA and most of West Europe during the last 30 years, since the Three Mile Island accident in the US in 1979.

The US and European companies in nuclear power plant equipment and nuclear fuel business are thus looking to Asia for markets – India, China and Japan spearheading the current expansion programme.

It is unfortunate that the Indian government is becoming their willing collaborator in this in pursuit of its megalomaniac hunt for nuclear power and weapon. It has thus, over a period of just one year, rushed to enter into agreements with as many as seven countries, viz. the US, France, Russia, Kazakhstan, Namibia, Mongolia and Argentina.

So far, nuclear power production capacity in India is very small, only about 3 percent of the total electricity generation capacity; and the veil of secrecy surrounding the existing nuclear power plants in the country, and absence of any truly independent monitoring agency, has seriously hindered dissemination of information on accidents – large and small – at these plants and their public scrutiny. That explains the current low level of popular awareness as regards the grave threats posed by the nuclear industry.

Taking advantage of this, the government of India is now set to steamroll its massive expansion program.

The contention that nuclear power is indispensable to meet future energy needs is false; for energy demand, and “need”, is obviously a function of the development paradigm chosen and pursued. And “energy security” is not an autonomous entity or objective, but must be in alignment with other chosen objectives which must include equitable growth and concerns for ecology.

Viewed thus, “energy security” may be achieved by: (I) Increasing efficiency of electricity generation, transmission and distribution. (II) Doing away with extravagant and wasteful use of energy. (III) Pursuing a path of low-energy intensity and decentralised development. (IV) Making optimum use of alternative energy options. (IV) Radically raising investment in development of sustainable and renewable energy sources and technologies, especially wind and solar energy.

As a part of its expansion program, the government of India has announced plans to expand the nuclear power plant coming up at Koodankulam (Tamil Nadu). Additional four reactors from Russia of 1,200 MWe each, in the immediate or near future, are to come up over and above the two of 950 MWe each, presently under construction. The process for setting up a nuclear plant at Jaitapur (Ratnagiri district, Maharashtra) has also reached an advanced stage. The French company Areva is set to supply two new generation reactors of 1650 MWe each, to be followed by another two. Land acquisition notices have been served on the local people to acquire 981 hectare of land.

The government has reportedly already approved 15 new plants at eight sites. These sites are Kumharia in Haryana – meant for indigenous reactors; Kakrapar (indigenous reactors) and Chhayamithi Virdi (reactor from US) in Gujarat; Kovvada (reactor from US) in Andhra Pradesh; Haripur (reactor from Russia) in West Bengal; Koodankulam (reactor from Russia) in Tamil Nadu; and Jaitapur (reactor from France) in Maharashtra.

Similarly, the mad rush for more and more power plants is matched by an accelerated drive for uranium mining in newer areas: Andhra and Meghalaya, in particular. And this, despite the horrible experience of uranium mines in different parts of the world, as also in our own Jadugoda – where appalling conditions continue despite strong popular protests, spanning decades.

In view of all these facts enumerated above, we the undersigned demand that the government of India put a complete stop to the construction of all new uranium mines and nuclear power plants, and radically jack up investments in renewable and environmentally sustainable sources of energy.

We also earnestly urge you to intervene immediately.

In the early days of the current economic crisis, the Treasury Department demanded from the U.S. Congress a 700 billion-dollar bailout to buy up the “bad paper,” a term for all the junk assets owned by the banks and mortgage companies. Bad paper – the phrase was an evocative one, and the next time I found myself walking past a Barnes & Noble Bookseller, looking through the broad front windows at the stacks of unsold “bestsellers” on the display tables, I couldn’t help but imagine the CEOs of the Big Six publishing corporations scurrying to Washington D.C. to demand their own big slice of bailout pie. After all, who could have more bad paper to unload than Random House, Simon & Schuster, HarperCollins Harcourt, McGraw-Hill, the Penguin Group, and Macmillan?

Correspondence Pamphlet No 1: Deconstructing ‘Terrorism’

‘All incidents in India that have occurred recently, which go by a blanket name “terrorist attacks,” have been viewed as self-explanatory. A terrorist and his acts don’t need any explanation. A terrorist is like any other professional who is supposed to do what he is trained for. Why does he do that – is not a question to be asked. It is his own “free will” which clashes with others’ free will.’ The old ‘criminal as victim’ argument took into account the fact that though free on surface, in the final analysis, a person is determined by her/his circumstances.We however have stopped using it as though overuse has sucked out wisdom and relevance from the cliché.

Discussion: “Indian State Must Stop Its War Against People”

In the past few months, the government, by repeatedly asserting its perception of the Maoists as the ‘biggest threat to internal security’, by criminalising the CPI (Maoist), and through a sustained project of trying to build a consensus against various forms of popular upsurge and dissent, has been creating ground for the onslaught that is now in the offing. No matter what they say about using the air force only for surveillance, it is clear enough that in this elaborate plan to wage war against its own people, the state will not, if needed, flinch from aerial bombardment. The idea that the IAF could be allowed to ‘retaliate’ in ‘self-defence’ while carrying out its so-called surveillance tasks is already being contemplated and bandied about in the top echelons of the Indian state and security establishment. Furthermore, the spate of arrests in Kolkata, and even Delhi, has created an atmosphere that resembles, to an alarming degree, the one created by Senator McCarthy’s ‘anti-communist’ witch hunt in the US of the 1940s and 1950s. It becomes important in such a situation to come together and question this sequence of events and the narrative that buttresses it. We invite you to a Press Conference-cum-public meeting – on October 19, 2009, at the Press Club of India, between 12pm and 3pm – in which we seek to discuss the following:

1. The government’s plan to wage war against, and possibly bombard, the people of the concerned area.

2. The arbitrary arrest of dissenting political organisers, dissident intellectuals and student activists in the name of curbing ‘Maoism’.

3. The validity of the idea of outlawing an organisation completely and thereby banning all its activities and, in effect, taking away all forms of expression from its members.

The meeting-cum-press conference is to be addressed by Parthasarathi Ray of Sanhati, writer Arundhati Roy, senior Supreme Court lawyer and civil rights expert Prashant Bhushan and members of the PUDR. Nepal: Comrade Gaurav speaks on Democracy and Cultural Revolution

Comrade Gaurav has recently been made one of the secretaries in the new Unified Communist Party of Nepal (Maoist) (UCPN[M]) leadership structure. WPRM (Britain and Ireland) activists met him at the party office in Paris Dand (Hill), Kathmandu, where we tried to get deeper into the issue of democracy, specifically the UCPN(M) concept of 21st century democracy, of holding elections under New Democracy, and how this relates to the theory and practice of Cultural Revolution. Following is the transcript of this interview:

“If they don’t change their ideological-political line, we don’t envision that they will be able to take part in those elections. The New Democratic system will not allow this if they don’t change their ideological-political line and behaviour.”

WPRM: In the current situation when the UCPN(M) has its sights set on New Democratic Revolution, it seems more important than ever to understand the party’s idea of 21st century democracy, competitive elections under New Democracy and socialism, can you explain this concept to us?

Comrade Gaurav: Yes we are now in the stage of completing the New Democratic Revolution. The New Democratic system is not a socialist system. It is a bourgeois democratic system. The difference is that the revolution is made under the leadership of the proletariat. The old type of bourgeois democratic revolution took place under the leadership of the bourgeoisie, but the New Democratic Revolution will take place under the leadership of the proletariat. When it is led by the proletariat it will lead towards socialism and communism. On the other hand, if the bourgeois democratic revolution is being led by the capitalist class, it will either consolidate capitalism or, if it develops at all, it will develop towards imperialism. That is the difference. So New Democratic Revolution in this sense is not a socialist revolution, it is a bourgeois democratic revolution but it is led by the proletariat. And, when the proletariat leads this revolution and the revolution is completed, then immediately it will move towards socialism. It will not consolidate bourgeois democracy, it will move towards socialism. This debate was seriously carried out during 1956 in the Chinese Communist Party (CCP). People like Deng Xiaoping said that since it is a bourgeois democratic revolution, it is the time to consolidate capitalism. But, Mao said that it should not be consolidated, it should go forward to socialism. This is the basic division between New Democracy and socialism. And, the question of which class is leading is the fundamental question.

So far as elections are concerned, under a New Democratic system there will be a broad anti-feudal and anti-imperialist alliance. This will be the class character of New Democratic Revolution. It is certainly true that not all anti-feudal and anti-imperialist forces are communists. But there should be a broad alliance of the UCPN(M) with different political forces who are anti-feudal and anti-imperialist. We have to recognise the existence of these other political forces, because they are the ally of the proletariat during New Democratic Revolution. Therefore, we have to guarantee their political freedom, and the political freedom of those parties has already been carried out in China also. In China, except for the CCP there were nine other political parties, all of which were anti-feudal and anti-imperialist. They competed and participated in elections with the CCP and some of them became ministers in the government. In our case also we have to recognise those forces. They are not communists but they are the allies of anti-feudal and anti-imperialist forces, and they should be guaranteed political freedom.

When our party talks about multiparty competition or democracy, we are talking about our concept of ‘21st Century Democracy’. The difference here however is that in China there was a condition, all anti-feudal and anti-imperialist forces had to cooperate with the CCP. This was the precondition. But now our party is talking about allowing those political parties to compete even with the UCPN(M). In China there was a precondition, they were not allowed to compete but had to cooperate. In elections they made some sort of compromise or negotiation and they fixed candidates by consensus. In some constituencies the other parties put forward their candidate and the CCP did not. And in most other seats they did not have a candidate but supported the candidate of the CCP. But here in Nepal today we are talking about competition. All those political parties will be allowed to compete with the UCPN(M). We can have direct elections with those parties and the Maoists. That is the difference. We are formulating this kind of thing because the imperialists and the capitalists, who are the enemies of socialism and communism, accuse communist parties of not allowing other parties to compete. They say there is no competition, there is no democracy. And in fact, in the old way there was scope for those political parties to confuse the masses. For example, there is an election but there is only one candidate, and if everybody has to vote for the same candidate what is the meaning of this? It is something like selection. But we will make it clear that people can vote for their own candidates and that there will be more than two candidates for people to choose between.

Furthermore, we should give the people the right of recall. If the candidate elected by them is not competent, or is taking an anti-people road, the people’s right of recall will be assured. This is the type of thing we have to introduce in an electoral system. Only then can we assure the masses that they can vote for the candidate they like and it is a real election where there are many candidates. The election will have a definite meaning. If there is only one candidate then voting is meaningless. This is what we mean by ‘21st Century Democracy’.

WPRM: How will this democracy and use of elections develop as New Democratic Revolution develops into the stage of socialism. Will there be more than one communist party at this time?

Comrade Gaurav: We don’t envision more than one Communist Party because every political party has a class character. The proletariat should have their own party. In the long run, ultimately, there will not be different political parties. When we achieve socialism in that case, we think there will be no necessity for other political parties, because the society will have undergone a big change. There will be no other classes at that time.

WPRM: Do you envision a role for Nepali Congress and CPN (United Marxist-Leninists) after the New Democratic Revolution?

Comrade Gaurav: If they don’t change their ideological-political line, we don’t envision that they will be able to take part in those elections. The New Democratic system will not allow this if they don’t change their ideological-political line and behaviour.

WPRM: Comrade Basanta in Worker #12 has recently written that the Great Proletarian Cultural Revolution in China is the pinnacle of application so far in practice of dialectical materialism, the science of revolution. Can you sum up for us the lessons of the Cultural Revolution as formulated by the UCPN(M)?

Comrade Gaurav: We think the Cultural Revolution is the pinnacle of the development of Marxism-Leninism-Maoism. Because Marxism-Leninism-Maoism is a science in the process of development, it is not something static. It is in the process of development and this development is interlinked with revolutionary practice. From this practice comes our ideology. And from revolutionary practice, the experiences of the Russian and Chinese revolutions, and from the examples of counter-revolution in those countries, Mao synthesised the whole thing and developed the theory of Cultural Revolution. What Mao developed in his life, was more than that which Lenin did in his time, because for Lenin it was not possible to carry out Cultural Revolution or theorise Cultural Revolution. During his life, in the period of revolution and after that he was trying to develop the whole revolution. He formulated so many ideas and theories regarding revolution. But in the case of Mao, during that time China was not a capitalist country, it was a semi-feudal semi-colonial country. So the responsibility of the CCP was to carry on to accomplish the bourgeois democratic revolution and also to carry on the socialist revolution. It was a historical necessity for the CCP to carry out both these tasks. The CCP, under the capable leadership of Comrade Mao, led these two revolutions and in the process of developing socialism, learned the lessons that Mao took from the capitalist restoration in the USSR and many attempts to reverse the revolution within China itself. These were the materials for Comrade Mao Zedong to develop Cultural Revolution. With all these materials Mao developed our ideology to a qualitatively higher level. And we think the Cultural Revolution is the pinnacle, it solves the problem of revolution in that it can prevent counter-revolution. Many people say that the Cultural Revolution was a Chinese phenomenon, it was done in China, whether right or wrong, so it is a Chinese question. But we think it is not a Chinese question, it is a question of theory and it is a question of ideology. So it is a universal theory. And we uphold Cultural Revolution as the universal theory of communism. It holds good for China, and it holds good for Nepal also.

WPRM: Indeed, Mao said the bourgeoisie is not just outside the party but right within it. How will elections help to uncover the bourgeoisie within the party?

Comrade Gaurav: Elections will not help with this. Through elections you cannot root out the bourgeoisie within the party. To root out the bourgeoisie within the party you have to carry out Cultural Revolution, to find out who are the capitalist roaders within the party. The process of elections will not determine all these things. The process of elections relates to the time when there are other political parties who are the allies of the proletariat. We will compete with those parties only, not with the puppets of feudalism and imperialism. There is no point competing with reactionaries. Competition means to compete with allies, friendly competition only. So dictatorship will still be applied against reactionary political parties, pro-feudal and pro-imperialist parties.

So far as capitalist roaders within the Communist Party are concerned, this question will not be resolved through elections. That is different. Elections are concerned with forming the government and some matters of state. But the party of the proletariat should resolve the contradictions within the party in a different manner. In that case we have to apply Cultural Revolution. Cultural Revolution means the party should be interlinked with the masses. The masses will be given full rights to expose the leaders of the Communist Party. If they are really capitalist-roaders, they have to be exposed. This is the mass line as formulated by Mao. He made the slogan ‘bombard the headquarters’. Headquarters means your own headquarters, not the headquarters of other parties, but the headquarters of the Communist Party. Because in the headquarters there are many capitalist roaders, so people have every right to bombard that headquarters. People should be mobilised to expose the capitalist roaders. Only through Cultural Revolution can we root out capitalist-roaders.

WPRM: The Cultural Revolution involved many examples of the practice of democracy, such as the right to bombard the headquarters, the four great freedoms, big-character posters, the formation of Red Guards, the 3-in-1 committees, and even the Shanghai commune, not to mention the reorientation of health care, education and development towards rural areas. Why do you think elections under New Democracy can best provide democracy to the people?

Comrade Gaurav: Democracy as defined by the capitalists or imperialists is, according to their own definition, only political freedom, or competing in elections. But for us this is not the only characteristic of democracy. Democracy means the rights of the people for food, healthcare, education, all the economic requirements. These are fundamental things for our democracy. So we prefer a different definition of democracy. What Mao put forward in the Cultural Revolution, these are definitely things of democracy. We uphold all these things. But despite all of these requirements, we think elections are also necessary. In the nature of electing the representatives we prefer competition, but only during the stage of New Democracy. When the society changes totally to socialism, then elections will maybe not be necessary. We are talking about New Democracy. When the society has been changed to socialism, the situation will be different. We cannot claim now that the same method of elections will be applied during socialism. When there are various different political parties during the stage of New Democracy then there is competition between the political parties. But in socialism the class character of society will have changed, fundamentally changed. In that case there will be no need for various different political parties. And clearly the existence of political parties will be actually not necessary. They will not exist. In that case elections will not be needed.

WPRM: How will the practice of Cultural Revolution and the holding of elections prevent capitalist restoration? Which will be decisive?

Comrade Gaurav: As I have said, we cannot predict the form of elections under socialism. But the method of elections will definitely not be decisive to prevent capitalist restoration. Only Cultural Revolution can do that.

WPRM: According to Mao, not one but many Cultural Revolutions will be needed during the stage of socialism, which will last for many generations.

Comrade Gaurav: Yes, we very much agree with this principle that the Cultural Revolution should continue. When the Cultural Revolution was terminated in China, the result was capitalist restoration. This history is there for everyone to see. After the death of Mao, the revisionists said the Cultural Revolution was not necessary. They called those ten years a decade of catastrophe, the revisionists, that was their summation. But during the time of Mao the Cultural Revolution was not always directly carried out. Mao was almost bedridden, and immediately after his death it was reversed. If the Cultural Revolution had been carried out further, definitely it would have prevented the restoration of capitalism. So from the practice of China, we can realise that to prevent capitalist restoration we have to continue the Cultural Revolution. In China, the Cultural Revolution was carried out for ten years, but that was not enough. It was only enough for that period. We must directly carry out a continuous process of Cultural Revolution.

WPRM: Elections in imperialist countries at present are a bureaucratic procedure that hide the dictatorial nature of capitalist society. How will elections under New Democracy provide a mechanism for the continuous revolutionisation of the masses as well as mobilisation against the danger of capitalist restoration?

Comrade Gaurav: We think that on the issue of what type of election and how the election will be carried out, there is one fundamental question: who is leading the state? Which class is leading the state? Now the election to the Constituent Assembly was only possible because the state was in some sort of transition. But we are not always in the period of transition. It is a temporary period. In this period the state is not so powerful. It was possible for our party to take advantage of this because of the revolutionary intervention of the masses, during the People’s War and the 2006 People’s Movement. It was possible for our party to win, to be victorious in the elections. But the same situation will not continue for a long time. The state will consolidate itself and its own class character. In that case it cannot be in transition. So it all depends on which class is in power. That is the fundamental question.

This will be defined by the constitution, so now our struggle is concentrated on the question of constitution. What type of constitution will there be? Basically there are two positions: whether it will be a People’s Federal Republic, in short a People’s Republic like that in China but taking into account some particularities of Nepal, or a bourgeois republic, a capitalist republic. Our struggle is concentrated on this point, the major point of struggle in our country at this time. Our party is for a People’s Republic, the other parties are for a bourgeois republic. If a People’s Republic wins, then that means the proletariat will have won, they will be in power and they will hold their elections under those conditions. And since they will already be in power there will be freedom for the people to vote according to their choice. But if the proletariat is defeated, if there is a bourgeois republic in power, then the capitalist class will have won, and definitely they will use the same method that the capitalists of the world use during elections. We are in the transitional period and the constitution will define what type of system there will be in Nepal and which class will be in power. The type of electoral system will also depend on the outcome of this fight or struggle for a new constitution.

WPRM: Now that there is increasing talk of the third People’s Movement and the coming insurrection, can you explain how the UCPN(M) envisions the New Democratic Revolution taking place? Is it possible to do this through elections?

Comrade Gaurav: When we talk about Jana Andolan (People’s Movement) 3 we are talking about mobilising the masses. In the mobilisation of the masses, there are a few things that we have to take into account. In the revolution in Nepal at this present moment, talking about a People’s Republic is not an illegal matter, an illegal political question for accomplishing the revolution. It is a legitimate question. The other political parties can fight for their republic, why can the Maoist party not fight for a People’s Republic? We have every right to fight for the achievement of the people’s revolution. People’s Republic means New Democracy, because when New Democratic Revolution was accomplished in China the state was called a New Democratic Republic. New Democratic Revolution and People’s Republic are the same. There is a chance that through the constitution-making process we can write a new constitution of People’s Republic. But that cannot be achieved without mass upsurge. This is because in the given situation, the Maoist party is in favour of a People’s Republic, but we do not have enough support in the Constituent Assembly to write our type of new constitution. On the other hand, all the other political parties except for the Maoists also don’t have enough support to write their type of republic into the constitution.

In this specific situation in Nepal, only Jana Andolan 3 can resolve the problem of writing a constitution. The new constitution cannot be written only in the Constituent Assembly. This is neither possible for us nor for them. When we have to write the new constitution, only Jana Andolan, a people’s upsurge, can put pressure on and create the situation whereby all the other forces excluding the reactionary forces would support the Maoist proposal. There is thus some possibility of a People’s Republic. But in all cases only the people’s upsurge, or people’s movement, will complete the revolution. And our party is in favour of Jana Andolan 3. Now we call it people’s insurrection, or people’s revolt. But only a people’s revolution can play the decisive role in making New Democratic Revolution.

WPRM: What role do you think Maoists and anti-imperialists around the world can play on these questions of democracy and the construction of socialism, and the successful completion of New Democratic Revolution in Nepal? How can we raise the debate on these questions in the international arena to a higher level ?

Comrade Gaurav: At the present stage we are not going to carry out socialist construction. The present task of the revolution is to accomplish New Democratic Revolution. Only then can we carry out socialist transformation. Now we are in the stage of New Democratic Revolution. And the international proletariat should support the Maoist movement in Nepal to accomplish the New Democratic Revolution. We think that a revolution cannot be replicated, only developed. It cannot be a photocopy of other revolutions. It will not be a stereotype of revolution. The Nepali revolution is based on certain fundamental principles of Marxism-Leninism-Maoism, but it will have its specific character. In the case of China, Mao called this the ‘Sinification of Marxism’. We have to accomplish the revolution, based not on exactly what has happened with any other revolution of the world, which took place in history under the leadership of a Communist Party. Although the basic and fundamental guiding principles remain the same, there are many different aspects, including the security of that country, the international situation and other developments in the last decades.

Our party thinks that in the given situation the present line of the party can lead to the completion of New Democratic Revolution. So our class internationally should support the forms put forward by our party to accomplish the revolution. They can make suggestions. But we are formulating tactics on how to achieve the revolution and this does not exactly correspond to other revolutions. Our comrades are in different countries. They read the newspapers and the documents and all the other things, and they find the weaknesses and start to say that we are no longer communists, that we are revisionists. From outside analysis they will find differences. But what is the reality? The reality of the situation is quite different. And in the present reality we have to accomplish the revolution. That is the major task of the UCPN(M). We have formulated our line based on the concrete reality of Nepal, the present national and international situation. We think other comrades can make suggestions, because there is danger. When we are in a new experience there is also risk, there is also danger, of deviating towards the right.

Our comrades should give their sincere suggestions, which we will accept. But they should not condemn the revolution. If this revolution will be condemned or will not be cooperated with by our class internationally, it is hard for us to succeed. And we feel that communists will not help on these questions by doing that. In fact we expect from our comrades internationally that they should give suggestions, they should express their political concerns about whether the party or line has been deviated. But it is their responsibility to always support us. Condemning the revolution as a whole, or not making any positive contribution to the revolution, that is not a good thing. That is not proletarian internationalism. And if we succeed then communists around the world should welcome our revolution, and our comrades should celebrate. But more important is to think of what is your own contribution? Making revolution, that is your contribution. Communists have to continue accomplishing their own revolution. And we very humbly request this from the comrades of the world. We are doing our duty to accomplish the revolution in Nepal. We have no other objectives than to accomplish the revolution. We are struggling for that, and we believe we will be successful in making revolution in Nepal. We are confident.

A Pretext to Impose Brutal Repression: the Government’s “Offensive” Is a Formula for Bloodshed and Injustice

The Campaign for Survival and Dignity, a national platform of adivasi and forest dwellers’ mass organisations from ten States, unequivocally condemns the reported plans for a military “offensive” by the government in the country’s major forest and tribal areas. This offensive, ostensibly targeted against the CPI (Maoist), is a smoke screen for an assault against the people, especially adivasis, aimed at suppressing all dissent, all resistance and engineering the takeover of their resources. Certain facts make this clear:

The government tells us that this offensive will make it possible for the “state to function” in these areas and fill the “vacuum of governance.” This is grossly misleading. The Indian state is very, very active in these areas, often in its most brutal and violent form. A vivid example is the illegal eviction of more than 3,00,000 families by the Forest Departments a few years ago. Laws have been totally disregarded; Constitutional protections for adivasi rights blatantly ignored and their rights over water, forest and land (jal, jangal, jamin) glaringly violated. Every month an increasing number of people are jailed, beaten and killed by the police. If this is the picture of what “absence” of the state means, people are terrified of what the “presence” of the state will mean. It can only mean converting brutalized governance into militarized rule, a total negation of democracy.

This is not a war over “development.” People’s struggles in India today are over democracy and dignityMeaningful development must contribute to strengthening the right of all people to their resources and their production, and thereby to control over their own destiny. For generations, adivasis have fought for their Constitutional rights and entitlements. More recently, mass democratic movements have fought for new laws and policies, such as the Panchayats (Extension to Scheduled Areas) Act (PESA), the Forest Rights Act, the right to work and the right to food, in addition to earlier laws like the Minimum Wages Act, the Restoration of Alienated Lands Acts, and land reform and moneylending laws. These laws make it possible for people to fight for greater control over their lives, their livelihoods, their lands and their forests. However these laws are respected more in the breach; if the government wants “development”, let it first stop the blatant disregard of its own laws. Let people determine the path of their own development, in accordance with their rights over their resources and the type of infrastructure they desire. The Constitution itself requires this kind of planning. The claim that “development” can be provided through military force is both absurd and ridiculous.

This war is not about “national security”; it is about ‘securing’ the interests of global and Indian capital and big business. Any government worried about security would send its troops against mining mafias, the forest mafias, violent vigilante groups like the salwa judum and others. Rather than being curbed, these killers are in fact supported by the police. Have the security forces ever been deployed to defend the people struggling to protect themselves, their forests, their livelihoods and their futures? The answer is no. The notion of “security” being advanced by the government clearly has nothing to do with the people. Rather, it is to enable big business to engage in robbery and expropriation of resources, which they have decided will be one of their main sources of accumulation. Hence, mining, “infrastructure”, real estate, land grabbing, all aimed at super-profits, are being projected as “development” needed by the people. Huge amounts of international and government money are being pumped into so-called “forestry projects” which displace people from their lands and destroy biodiversity (even while they are trumpeted as a strategy for climate change). The UPA is rushing into agreements with the US and other imperial countries to throw open mining and land to international exploitation. But where do the forests, land, water and minerals lie? They are found in the forest and tribal areas, where people – some organised under the CPI (Maoist), some organized under democratic movements, some in spontaneous local struggles, some simply fighting in whatever manner they can – are resisting the destruction of their homes, resources and their lives. The “offensive against the Maoists” is only a subterfuge to crush this citizens’ resistance and to provide an excuse for more abuse of power, more brutality and more injustice.

The government knows perfectly well that it cannot destroy the CPI (Maoist), or any people’s struggle, through military action. How can the armed forces identify who is a “Maoist” and who is not? The use of brute military force will result in the slaughter of thousands of people in prolonged, bloody and brutal guerrilla warfare. This has been the result of every “security offensive” in India’s history from Kashmir to Nagaland. So why do this? And why now? Unless the goal has nothing to do with “wiping out the Maoists” and everything to do with having an excuse for the permanent presence of lakhs of troops, arms and equipment in these areas. To protect and serve whom?

Hence the need for fear mongering and hysteria about Maoist “sympathisers” and their “infiltration” into “civil society.” The government has a very long history of labeling any form of dissent as “Naxalite” or “Maoist.” The Maoists’ politics are known; their positions are public; the only secret aspect of their work is their personal identities and military tactics. We who work in these areas do not fear this bogey of “infiltration” in our groups by Maoists, for the different stands taken by our organizations and theirs are clear, and in some areas there are open disputes. This scaremongering is just an excuse to justify a crackdown on all forms of dissent and democratic protest in these areas, a crushing of all people’s resistance, and the branding of any questioning, any demand for justice, as “Maoist.”

In the final analysis, peace and justice will only come to India’s workers, peasants, adivasis, dalits and other oppressed sections through the mass democratic struggle of the people. A democratic struggle requires democratic space. The conversion of a region into a war zone, by anyone, is unacceptable. In the forest areas in particular, there is now a need for a new peace, one that can only be achieved through a genuine democratic dialogue between the political forces involved. For this to happen, this horrific “offensive” must first be called off. If the government really wishes to claim that it is committed to protecting people and their rights, let its actions comply with the requirements of law, justice and democracy.

What is Happening in Pricol?

The unfortunate death of the Vice President of the Human Resources Development Department of Pricol Ltd is regrettable indeed. Coming one year after the Graziano incident in Greater Noida in which the local head of an Italian firm had reportedly been beaten to death by sacked employees, it has evoked a lot of passionate comments and demands from the corporate world. Even as workers are being arrested in large numbers and leaders are being framed, employers are demanding a ban on trade union struggles and sections of the corporate media are advocating labour reforms to give a completely free hand to employers.

A single day’s tragic incident is now being deliberately sought to be used to prejudice public opinion against the Pricol workers and suppress the truth of the nearly one thousand days of their united and determined struggle. Among other basic things, a key demand of Pricol workers has been for the recognition of their unions which enjoy the support of the overwhelming majority of workers while the management has been constantly pressurizing workers to withdraw from the road of struggle and sever ties with the ‘Marxist-Leninist’/’Maoist’ leadership.

In this long struggle of Pricol workers, the government of Tamil Nadu has repeatedly censured the Pricol management. The state government has issued three advices, passed one government order (GO) prohibiting the continuance of lockout, passed three GOs ordering references, passed two orders under section 10B of the Industrial Disputes Act (ID Act) 1947.

On 29th of July 2009 the state Labour Minister, while replying to a calling attention motion moved on the floor of the assembly by AIADMK, PMK, Congress, CPI, CPI(M), catalogued the various unfair labour practices indulged in by Pricol Ltd, and stated that the workers had given up their indefinite fast which had been continuing for the 15th day as their demands were accepted by the government. He further assured that the government would not let the workers down.

Have things completely changed in a few months and more particularly on a single day with the unfortunate death of an executive? In the heat and passion generated by this tragic incident, can we allow rational reasoning to become a casualty?

Mr George’s Unfortunate Death was Neither Preplanned Nor the Result of Conspiracy

Mr Kumarasami addressed the general body meeting and one office bearers’ meeting on 19 and 20 September 2009. As a practising labour lawyer in the Madras High Court for nearly three decades and AICCTU’s national and state president, he is conducting all the Pricol cases in Madras High Court as well as the Supreme Court. Going to Coimbatore basically to reassure the workers not to worry about the delay, as the Pricol case would be coming up for hearing on the 29th of September before the Madras High Court, he categorically cautioned the workers not to get provoked by any vindictive action of the management. He also proposed a padayatra from Coimbatore to Chennai to highlight the demand for a trade union recognition Act and several other burning issues of the toiling people. It was also planned to celebrate the 1000th day of the struggle to positively counter the frustration being caused by the delay in legal struggles and the recalcitrant attitude of the management.

Can by any stretch of the imagination these proposals to impart a stronger mass political dimension to the protracted struggle of Pricol workers be construed to be part of any conspiracy, ‘Maoist’ or otherwise?

In this connection it would not be out of place to remember that just the other day, Naresh Goyal of Jet Airways called his pilots who formed a union ‘terrorists’. And he withdrew the terrorist label and embraced them as prodigal sons as soon as they returned to work, leaving aside the issue of union for the time being.

It Will Be Better If the TN Police Consults the TN Labour Department on Pricol Ltd:

Pricol’s track record in the arena of industrial relations has been notorious. Rampant violation of labour laws, court verdicts and government orders has been the trademark of the Pricol management.

• There are vindictive transfers.
• There is refusal to engage in collective bargaining in good faith with the majority union.
• There are illegal partial lockouts.
• There are break-in-service orders.
• There are stoppages of increments.
• More than 1000 employees are terminated.
• There is illegal deduction of wages and incentives running into crores of rupees.
• The management has promised to pay all these withheld dues if the workers leave the unions.
• There is employment of apprentices and contract labour contrary to certified standing orders and the Contract Labour (Abolition and Regulation) Act, 1970.
• Now there is the recent dismissal of 44 workers without any domestic enquiry.

In almost all these issues the state government has intervened under sections 10 (1), 10(3) and 10 B of the ID act 1947.

In fact Comrade Kumarasami was trying to get the Labour Minister convene a meeting at the earliest to resolve the simmering discontent and this fact is known to the Labour Department.

The management does not want Comrade Kumarasami to defend the Pricol workers in the High Court as well as the Supreme Court on the 29th of September and other subsequent dates. This is the main reason for implicating Comrade Kumarasami, the national president of a centrally recognised trade union.

Respect Industrial Democracy, Stop Witch Hunt Against Pricol Workers

If lawyers and TU leaders who defend and guide the workers are framed in conspiracy cases as during British days, the government will only be sending a loud message: “No healthy, strong collective bargaining will be allowed. Industrial relations are back to the pre-1926 colonial days.”

Should we allow the unfortunate death of Mr. George to be turned into a weapon for witch-hunt of workers and suppression of trade union rights – instead of treating it as a poignant issue for remedial action? Let the unfortunate incident motivate all parties to take remedial measures that will help resolve the real underlying issues.

With the Trade Unions Act coming into force from 1926, the country had gradually moved away from lawlessness to the rule of law by instituting a system of collective bargaining. If employers like Pricol Ltd. are allowed to violate the law and make use of an unfortunate death to go in for a witch-hunt, implicating leaders in false cases, and suppressing basic trade union rights, will that not be only sending out the message that there is no place for laws and effective trade unions in independent India in the days of globalisation?

TN government and central government should not act on the basis of one-sided corporate hue and cry. TN government should come to the aid of Pricol workers, their families and their leaders, as it has promised on the floor of the assembly. We appeal to all trade unions and progressive and democratic sections of society who believe in the dignity of labour and rights of workers to support the struggle of Pricol workers and express solidarity by calling upon the TN government to stop the ongoing witch hunt and force the arbitrary Pricol management to respect industrial democracy and implement government orders.
